It’s a long list when you’re looking at the states it’s legal to grow hemp in 2019 — especially since only three states in the entire country didn’t make the cut.

That said, the restrictions placed by agricultural departments at the state level can severely impact the opportunities for hemp growers.

The 2018 Farming Bill paved the way for farmers to cash in on this incredible crop. However, it’s necessary to research the laws in your state before you get your hopes up. In addition to looking at the current regulations — with so many legislatures reviewing laws regarding industrial hemp growing — you’ll want to keep an eye on what’s potentially coming down the pipeline as well.

Industrial Hemp Farming – Where Is It Legal?

The industrial hemp farming act removed the plant from the list of controlled substances. The 1937 Marihuana Tax Act ban included hemp. However, farmers grew it in locations like Kentucky during the 1950s! It was also widely grown during World War II due to its many uses, which we discuss later on.

The Bill didn’t legalize CBD, nor did it guarantee the legal operation of an industrial hemp farm in every state. It made it clear that states had to develop a plan and submit it to the United States Department of Agriculture (USDA). Therefore, states are allowed to prohibit the growth of the plant.

At present, Idaho stands alone as the only American state to prohibit industrial hemp cultivation. Both Mississippi and South Dakota passed legislation in hemp’s favor in 2020. Incidentally, both states also legalized medical marijuana in November 2020. South Dakota went a step further. Recreational cannabis could be on sale in SD from 2022.

According to News America, Indiana is now one of the twenty-nine states with approved hemp licensing for commercial businesses.

Many states have submitted their plans for approval. Others have yet to do so and are happy to fall back on the Farm Bill regulations.

If you intend to grow hemp, there are plenty of considerations. Too many farmers are seduced by the potential riches that await them. Some estimates suggest one can earn $100,000 per acre. Of course, you must subtract a myriad of expenses. Nonetheless, this is less of an issue if you grow over 100 acres of high-quality hemp! In most states, up to 90% of all hemp is developed for the CBD industry. This is a shame because it is a crop with phenomenal potential.

What Are Industrial Hemp’s Uses?

The number #1 use of the crop is for the billion-dollar CBD market. It is understandable but limits the potential of this fantastic plant. If you think long and hard, you could develop a long list of useful industrial hemp products. Remember, this is a crop that once dominated the American landscape. Estimates vary, but it is believed that you can make approximately 25,000+ products from the plant!

The settlers at Jamestown in Virginia grew the crop in the 17th century; it was mandatory! Copies of the Bible were made with hemp paper, as was a draft of the Declaration of Independence. Humans used the crop for centuries with industrial hemp fiber, a particular favorite. In the early 1900s, hemp-derived cellulose was championed as a renewable and affordable raw material for plastics.

The key will be to get yourself situated in a state where it’s legal to grow hemp in 2019, and then get your hands on the right seeds and clones to ensure you have the highest quality crop come harvest time

The article also stated Indiana has started accepting hemp cultivation and processing licenses in November for the 2021 growing season. The state is offering one general hemp license and another one for agricultural hemp seed production. Applicants are also required to submit their personal address, GPS coordinates, where the hemp is located and a legal description of the property used for the hemp operation.

Many other states are also currently negotiating commercial hemp licensing plans with the U.S. Department of Agriculture as farmers increasingly seek to grow hemp for manufacturers seeking cannabidiol (CBD), cannabinol (CBN) and cannbigerol (CBG) for oils, lotions, foods and beverages. With more than 25,000 uses for hemp, farming hemp for textiles, insulation, pet bedding and more are increasing at an exponential rate.

One theory posits that hemp’s ability to replace synthetic materials such as plastic and nylon was a primary reason for its prohibition. You could make the argument that hemp was a threat to certain industries. DuPont produced neoprene in 1930, for example. However, the same company didn’t invent and patent nylon until the mid to late 1930s.

Incidentally, there is disagreement over the year that nylon was patented. Some sources suggest it was 1937, pbs.org suggests it was 1935, and other sources say it was 1938.

Regardless of the year, the anti-marijuana hysteria in the United States was already at a fever pitch by the mid-1930s. Perhaps the likes of the DuPont family were heavily involved in the Marihuana Tax Act of 1937, though we’ll never know.

What we do know is that the world was robbed of an incredible resource for decades. There are thousands of uses for hemp. Perhaps one of the most important is as a replacement for plastic. Hemp plastic is an eco-friendly alternative to the carbon-based plastics we use today. The hemp version is usually recyclable and biodegradable.

It is hard to believe that it has been only One Year since the full Legalization of CDB in the USA.

Depending on where you live, you may have started to see “CBD” products – capsules, tinctures, salves – pop up in your natural food stores or even at the supermarket. With all the misinformation out there, you may have questions about the health benefits of this non-psychotropic medicinal as well as its different forms and delivery methods. Homeostasis helps to regulate vital functions in the body like the immune, digestive, central nervous, and cardiovascular systems. The EC system, therefore, plays an important role in body functions like sleep, perception of pain, metabolism, cognition, and pleasure, and CBD helps modulate these functions. The list of conditions CBD may treat continues to grow, but the following have the most anecdotal evidence.

Sleep

CBD improves the quality of sleep by helping people fall asleep and stay asleep. While it’s been shown to assist with sleeping disorders like insomnia, it also alleviates the symptoms that disturb a good night’s sleep, such as stress, anxiety, and restlessness.

Pain Management

Because CBD is an anti-inflammatory, it’s great for pain, especially with conditions like arthritis, fibromyalgia, migraines, cramps, and even gut-related disorders like colitis and Crohn’s disease. This includes nausea, vomiting, and lack of appetite associated with chemotherapy, as well as pain. Although more research needs to be conducted, CBD used in combination with chemotherapy could assist in combating cancer cells and suppressing cancer cell growth overall.

Hemp – vs. Cannabis-Extracted CBD

But if you’re not sensitive to a little THC, there are benefits to cannabis-derived CBD.

Hemp-Derived CBD

The 2018 Farm Bill legalized the cultivation of hemp, removing hemp and hemp-derived products from its former Schedule 1 status within the Controlled Substance Act, making CBD derived from hemp federally legal in the U.S. so that it’s accessible to anyone that wants to try it.

At your local health food store, you’ll typically find CBD oil, capsules, tinctures, salves, and edibles like chocolate. The dosage of these products varies, and where to start depends on your tolerance and ailment. Taking 10-25 mg of CBD is a great place to stat for newbies. If you’re especially sensitive to medications you may wish to start at 5 – you may not feel the effects of the medicine, but it will provide a gauge for how your body will respond.

Once you’ve experimented a bit with the options, you may wish to branch out. You can go online and search “hemp-derived CBD products” and find a multitude of choices, but here’s where things get a bit tricky. While the FDA has regulatory authority over CBD, it has not established any definitive set of rules for the industry other than barring cannabidiol products from being sold as dietary supplements. As a result, there are serious quality control issues in the market at the moment. Products can be poorly labeled, have inconsistent quality and/or be overly processed, or they might contain toxins like pesticides, mold, and solvent residues. This includes all pages of the report, showing what you don’t want it to have. Buy CBD products made with organic, American-grown hemp or cannabis. Consumer Reports suggests looking for products made in states that have legalized the recreational and medical use of cannabis since they have more regulations and testing procedures in place.

Cannabis-Derived CBD

If you live in a state where recreational use is legal, you can try CBD products from a licensed dispensary. The same goes if you live in a state where medicinal use is legal and you have your medical marijuana card.

While CBD derived from hemp has only trace amounts of THC, CBD derived from cannabis will include various amounts. Some people prefer cannabis-derived CBD, as the two cannabinoids -CBD and THC – work very well together, creating what’s known as the “entourage effect,” where each enhances the therapeutic benefits of the other.

There are strains of cannabis bred specifically to be high in CBD and low in THC, including ‘ACDA,’ ‘Cannatonic,’ ‘Charlottes Web,’ ‘Ringo’s Gift,’ ‘Sour Tsunami,’ ‘Harlequin,’ and ‘Hawaiian Dream.’

With extracts like CBD oils and tinctures, you can find different ratios available. A ratio of 1:1 for example, means there are equal parts CBD to THC. If you don’t want to be “high” or prefer milder psychoactive effects from the THC, look for high CBD ratios like 15:1, 10:1, and 7:1. For some, having just a little THC enhances the overall benefits of CBD without any negative side effects.

Numbers Don’t Lie. Florida Medical Marijuana Use reports another record week of cannabis sales ending December 20th, 2019

Record numbers are showing strong growth of medical marijuana sales in the state, and this is expected to continue as the state pushes for recreational cannabis legalization. High THC mg sold jumped up 38%, CBD mg sold jumped 8% from previous week.

Good – Bad – WTF Opinion Poll. *More than 200 million people smoke marijuana according to the 2019 World Drug Report and this number is increasing.

Opinion Polls really don’t matter anymore as much as the numbers. As they say, numbers don’t lie. It is difficult to investigate cannabis and its effects as it is a prohibited substance in most countries. Canada and Uruguay have legalized the herb and the same has happened in some US states.

There is much ignorance about the true legal status of cannabis in countries like the US. or the Netherlands. Legal regulations in these countries are inconsistent and the investigation is insufficient and even contradictory on some occasions.

The reality is that cannabis is the most consumed recreational substance (illegal or legal) worldwide. More than 200 million people smoke marijuana according to the 2019 World Drug Report and this number is increasing. This is good or bad? The answer is difficult to answer considering the inconsistency of global laws and having few research studies and, consequently, little concrete evidence of their long-term effects.

The inconsistency of the laws is especially evident in the United States. Any citizen of Colorado, a state in which cannabis was legalized in 2012, can legally purchase marijuana at a dispensary provided they have an identification document and are over 21 years old. That person crosses the state border to go to Kansas and faces a completely different legal status. Cannabis users in Kansas can be arrested and face prison sentences and high fines.

It is not easy to reach legal, moral and scientific conclusions when the same substance is legal or illegal depending on which side of the border you are on. The United States is not the only country with contradictory legal regulation.

The European Union has the highest rates of young people who use cannabis. Each member state has the power to decide on its drug policies. As in the United States, there is no general homogeneous legislation to regulate cannabis throughout the European Union. In the Netherlands you can smoke pot in some coffee shops without having legal problems. The same conduct in surrounding countries is punishable by legal sanctions that even involve jail time and significant fines.

Thomas Pietschmann, a UN drug researcher and co-author of the World Drug Report 2019, believes that although the situation in the United States and the states of the European Union may seem comparable, the reality is different.

Marijuana is not completely legal in the Netherlands. You can only sell and smoke in coffee shops designated for this purpose. It is true that cannabis is decriminalized, so people cannot go to jail for smoking a joint in public, something we cannot say about Kansas, for example. The purpose of coffee shops is not to promote cannabis use but to regulate and limit it to certain spaces.

It is complicated to build a public opinion about cannabis while it is legal or illegal just by crossing a border.

Since the decriminalization of consumption in the 1970s, cannabis use in the Netherlands has remained stable. The Dutch government has tried to curb the use of marijuana with the implementation of laws, prohibiting its advertising and restricting its sale only to Dutch citizens over 18 years. These laws are the result of an attempt to “wash your face” when the appearance of “marijuana tourists” became an annoying matter for some Dutch citizens.

Decriminalization is not the same as legalization. In our article “Adolescents consume less cannabis in states where it is legal” we refer to the latest research that shows that cannabis use in adolescents has been reduced by about 10% in those states where recreational marijuana is legal.

The decriminalization of cannabis use in the Netherlands is similar to that in most of the member states of the European Union. Drug policies in the European Union are based on harm reduction after the onset of HIV in the 1980s. Although most forms of drugs were criminalized in the United States, some states of the European Union implemented damage reduction policies.

In the United States drug regulators have changed their position over time. In the sixties and seventies, attitudes towards marijuana were very permissive. This situation changed in the 1980s with the so-called “war on drugs”, initiated by President Ronald Reagan, who began implementing zero tolerance policies. Any person arrested for possession of prohibited substances could be imprisoned.

In the 1990s, marijuana lost part of its stigma and social acceptance of the herb grew. In 2008, the first campaigns for the legalization of medical cannabis began. Medical marijuana was legalized and the herb began to decriminalize. Finally, the legalization of marijuana for recreational use for adults became a fact in some states and countries.

While cannabis use increases globally, adolescents in states where it is legal to consume marijuana for recreational use consume up to 10% less than before.

Pietschmann, who is also in charge of investigating drugs such as heroin and fentanyl, is not worried about people over 18 who smoke pot marijuana while doing so without abusing. Alcohol is a legal substance that involves many more risks than cannabis.

It is true that globally, young people over 25 consume more cannabis than before. But as we have said, teenagers smoke less in states where marijuana for recreational use is legal.

Pietschmann concludes that with the introduction of marijuana in the private sector, current cannabis has a higher THC content. This can have detrimental effects on American society. Previously, much of the marijuana exported to the United States came from Mexican farms and the herb consumed had approximately 5 or 6 percent THC. Technology has revolutionized the sector and now strains are obtained with more than 20% THC, so that the tolerance of people to the marijuana that is grown has decreased.

It is difficult to have a solid opinion about a substance that becomes illegal after crossing a border. Some governments legalize consumption while others send their users to jail. How can we draw conclusions and investigate more?

In order to draw real conclusions, marijuana should be legalized in all countries. As long as it is legal here and illegal there, there will always be a black market and we all know that the forbidden have a magnet effect among teenagers.

It is logical that cannabis use increases among citizens who feel free to consume and buy. What would be truly worrying is that it would increase the consumption of alcohol and opiates, which is what has happened in these in which cannabis remains illegal.

According to the World Drug Report 2019, 200 million people use cannabis. How many people consume alcohol, smoke tobacco and / or consume opiates? Many of those 200 million cannabis consumers are people who replaced opiates with cannabis.

Wood You Like To Swing On A Star? Sunshine State? Hemp Takes Over Timber Trail.

In the wake of Hurricane Maria, as it made it’s way throughout the panhandle of Florida, I was unaware of the total destruction of one of our state’s Agricultural Resources, Timber. Therein lies the rub. Florida’s next new resource should be farming, followed by what’s happening, up north, well Kentucky.

Now that it’s legal to grow hemp in the United States, a man who’s spent the last decade developing hemp “hardwood” is building a $6 million factory to manufacture the product.

His patented product called “HempWood” is made out of compressed hemp pulp fibers, held together with a soy-based glue.

While that may sound like some newfangled version of particle board, it’s not.

It looks and feels like oak, but is actually 20 percent harder than the famous hardwood tree.

It also grows 100 times as fast. While it takes an oak tree at least 6 decades to mature, it takes hemp 6 months.

That’s good news for oak trees, as they are among the most endangered trees in the planet because of the high demand for solid oak furniture.

The owner of the new start up company Fibonacci, Greg Wilson,  was a pioneer in the bamboo flooring industry before hemp became legal.

The company uses technology popularized by China’s strand-woven bamboo industry, in addition to technology developed at Wilson’s other company SmartOak, which creates engineered wood products using logs that would otherwise be converted to wood chips.

HempWood will be used to make blocks, boards, flooring, cutting boards and skateboards, all at prices far cheaper than oak, the company said.

The company will be headquartered in Kentucky, where more than 40,000 acres of hemp are already being cultivated.
