Light Up, Hempsters! Or Not?

 â€” North Carolina is the latest state considering a ban on smokable hemp, a product that’s exploding along with the health craze surrounding a compound in the plant known as CBD.

Besides federal regulations laid out in the Hemp Farming Act of 2018, the Food and Drug Administration has no additional regulations on smokable hemp, leaving states to figure out how to govern it themselves.

This year, Indiana, Louisiana and Texas banned smokable hemp entirely, while Kansas banned products including hemp cigarettes and cigars. Tennessee prohibited smokable hemp sales to minors.North Carolina’s House is considering a smokable hemp ban after it recently passed the state Senate.

The legislation focuses primarily on expanding the state’s pilot hemp growing program, which has more than 1,000 licensed hemp growers and 600 registered hemp processors, to position it as a leader in the burgeoning industry. The bill would place more regulations on hemp but also create a hemp licensing commission and establish a fund for regulation, testing and marketing.

North Carolina law enforcement wants the ban, saying officers have no way of distinguishing smokable hemp from marijuana.

Hemp and marijuana are both cannabis plants. Dried, smokable hemp looks and smells the same as marijuana but contains less than 0.3% of tetrahydrocannabinol, or THC, the compound that gives marijuana its high. Hemp has cannabidiol, or CBD, which many believe helps with pain, anxiety and inflammation, though there’s limited scientific research to support those claims. It’s turning up in products ranging from lotions and cosmetics to diet pills and juices.

The proposed ban would impose a civil penalty of up to $2,500 for anyone who manufactures, sells or possesses smokable hemp.

But scores of farmers in the traditional tobacco state have told lawmakers a ban would hurt them as many deal with hurricane damage and decreased tobacco prices.

Three years ago, Shane Whitaker grew 275 acres of tobacco on his farm in Climax. This year, the second-generation tobacco farmer planted only 75 acres of his former cash crop and decided to grow hemp.

“We’re hoping for a lot of this hemp to replace tobacco,” he said. “I’m not for taking part of it off the market.”

So far, he said that hemp has been a good source of revenue to keep his farm running.

Second-year hemp farmer Lori Lacy, who has invested more than $190,000 on her 13-acre Franklin hemp farm, said she can make $1,000 for a pound of smokable hemp flower.

“I don’t want our infrastructure and everything that we have built up to this point to go away,” Lacy told lawmakers at a May hearing. “I will have to fire people.”

Smokable hemp is lucrative partly because farmers just need to dry the hemp flowers. Other products require a complicated, costly process for extracting CBD oil.

Jamie Schau, who analyzes CBD markets for the research firm Brightfield Group, said the market for smokable hemp flower is projected to grow to $70.6 million in 2019, up from $11.7 million in 2018. However, she said stigmas around smoking help keep smokable hemp at only about 1.4 percent of the overall market.

Smokable hemp is especially popular in the South, where no states have legalized recreational marijuana and many haven’t legalized medicinal marijuana, said Eric Steenstra, president of advocacy group Vote Hemp. Still, its popularity has been a surprise, he said: “Nobody really anticipated that anybody would want to smoke (hemp).”

North Carolina’s Senate voted to delay the ban until December 2020 to allow more time to figure out regulation, but a House committee subsequently moved the date a year sooner. That version is continuing to move through the House.

Bill co-sponsor Republican Sen. Brent Jackson of Sampson County prefers the later effective date because he thinks portable tests will be available soon to differentiate hemp from marijuana.

The State Bureau of Investigation and the North Carolina Association Chiefs of Police say delaying the ban would be a “de facto” legalization of marijuana, since people could disguise marijuana as hemp.

Last month, police in Four Oaks charged Amanda Furstonberg, 32, with marijuana possession after they saw her smoking what she says was hemp.

“They had me in tears,” she said.

Furstonberg started smoking hemp after a February car accident left her with chronic back pain. To avoid opioids, she tried taking CBD-infused gummies as a pain reliever but wanted something stronger and turned to smokable hemp.

“Within three and five seconds of being able to smoke it, I could tell that my body was starting to feel so much better —the throbbing was going away,” she said.

Police Chief Stephen Anderson defended his officers, saying he believed Furstonberg disguised marijuana as hemp. Her case is pending.

For now, farmers continue to grow smokable hemp. This year, Whitaker will plant roughly 30 acres of organic hemp with about 2,400 plants per acre, along with another 800 in a greenhouse.

Driving past empty greenhouses that once held tobacco, Whitaker said farming requires adapting to constant changes.

“It’s the Wild West right now,” Whitaker said.

Florida “Hemp Bill” has Governor Signature. The “Hempen Peninsula” will “Crackdown On Products outside Sunshine States’ New Standards”.

Gov. Ron DeSantis closed out Tuesday signing legislation authorizing a state hemp program.

SB 1020, which creates an industrial hemp program under the auspices of the Department of Agriculture, cleared the Senate and House by unanimous votes this Session.

The bill, sponsored by Senate Appropriations Chairman Rob Bradley, would allow the Department to administer regulations regarding licensing and bcultivation of hemp, the THC-deficient cousin of marijuana.

The 2018 federal Farm Bill allows states to establish hemp programs such as the one contemplated in current legislation, as the federal rulemaking process could take years. Agriculture Commissioner Nikki Fried believes hemp could be the boost the state’s farm sector and rural areas need.

“Tonight’s hemp bill signing marks a transformation in Florida, and a critical step on the journey to creating a green industrial revolution, strengthening agriculture with an alternative crop of the future, and expanding access to safe, quality CBD products,” she said in a statement.

In February, Fried appointed Holly Bell as Florida’s first Director of Cannabis to oversee the department’s hemp program.

“For months, our Department has been developing rules and gathering public input, and we’re hitting the ground running to build a state hemp program that will be a model for the country. Florida has the potential to become the gold standard on hemp — our deep agricultural heritage, climate and resources, and farming infrastructure will make Florida a national leader in this emerging new economy.

“Congratulations to Sen. Bradley and Rep. Ralph Massullo (the House sponsor) for their hard work, diligence, and collaboration, and to the Legislature to helping move this across the finish line. Together, we will keep Florida growing.”

In addition to industry regulations, the bill also establishes a structure to ensure the purity and compliance of cultivated product for the protection of consumers.

Eyeing a “potentially lucrative future,” one “game changing” for the agricultural community, Bradley lauded this program as giving Florida a “head start against the rest of the country.”

“Put that effort on steroids,” Bradley urged on the Senate floor. “Give farmers an opportunity to reinvent efforts.”

A hemp bill “may be one of the most significant things we do this session,” Bradley added, allowing Florida “to become a hemp state.”

Indeed, with unanimous bipartisan support, the Sunshine State is on its way to becoming the hempen peninsula. The hemp legislation gives Fried more legal standing during her promised “crackdown” on hemp products outside the system.

Fried expects that crops will be planted this year. And not a moment too soon for a multi billion dollar industry!

Seniors on Board with CBD (THC Free) Benefits – Verses Pharmaceutical Meds.

As more and more people embrace CBD, replacing their pharmaceutical medications with it in their medicine cabinet, the senior citizens among us are also benefitting from its medicinal effects.

CBD is short for Cannabidiol, one of the compounds in cannabis and hemp that is alleged to have medicinal value. People who want to feel calm, need pain relief, or help to sleep, use CBD. When most people think of cannabis, they think about getting high, but that’s down to another compound in the plant called THC. A recent Remedy Review study of 1000 people aged 55 and over who used CBD came back with some interesting results. While the study found that only 9 percent of the seniors surveyed use CBD, at least 51 percent of that 9 percent reported “improved quality of life” overall. The survey also looked at the preferred delivery method for CBD for seniors and found that CBD Oil Drops were the most popular.

54.4 percent of participants preferred taking CBD drops on the tongue. 21.1 percent preferred to put those drops in their morning coffee or other beverage. And just 10 percent of the people surveyed said they liked to smoke or vaporize CBD.

The statistics on the reasons why seniors take CBD was also interesting. 42 percent said they took CBD for inflammation. Just around 41 percent said they took CDB to help with chronic pain. 38.6 percent use it to try and get a good night’s sleep. And 31.8 percent said they use CBD for arthritis pain. Interestingly, around 61 percent of the seniors who tried CBD said it helped to ease pain, while about 46 percent said it aided them with a good night’s sleep.

Most seniors prefer to take CBD oil under the tongue

This study, while not conclusive in any way, does show that CBD could be a great option for seniors, and could cut out some of the toxic pharmaceutical medications from their daily regime. As we get older, many people have the need for multiple regular medications.

Some seniors need to take pain killers including opioids regularly, while others will also need to take pills for blood pressure, inflammation, insomnia, and even anxiety. CBD is organic and non-toxic; it’s also non-addictive and carries no dangerous side effects. It’s also an excellent option for senior citizens as it is readily available and comes in many different, easy-to-use forms and delivery systems.

That means that many older adults just suffer in silence and get depressed as their quality of life plummets. That’s why CBD is such a great option for seniors and is well worth trying just in case it does the trick.

The USDA Legalized THC – But No One Noticed. Happy (Founding) Father’s Day!

It is indeed, Happy (Founding) Father’s Day, as I just learned some great news for all those who are waiting for it. It slipped under the radar last month, but the United States Department of Agriculture just descheduled tetrahydrocannabinol (THC).
The USDA issued a bulletin on May 28 as a legal opinion for hemp production. It basically authorizes interstate delivery of hemp and legalized THC derived from hemp.
First, let’s address the interstate transportation or shipment of hemp.
Up until December 2018, hemp was considered illegal like cannabis, but the 2018 Farm Bill legalized it. However, it still couldn’t cross state lines. So, farmers in states where all forms of marijuana were illegal could grow hemp but then had few options to sell their crops. Farmers such as the ones in Kentucky who had pushed Senator Mitch McConnell to get the Farm Bill signed in the first place.
Now they can sell those crops to producers in other states or at least extract the hemp oil and sell that derivative product.
This solves the farmer problem for McConnell who was getting backed into a corner to figure out how to help these individuals sells their hemp crops. Happy Kentucky farmers means reelection.
The second item within this USDA bulletin is the subject of THC, which is the part of the cannabis plant that produces a psychoactive response in the brain or the feeling of getting high. The bulletin was in response to the 2018 Farm Bill and it read, “By amending the definition of marijuana to exclude hemp as defined in AMA 297A, Congress has removed hemp from schedule I and removed it entirely from the CSA (Controlled Substances Act). In other words, hemp is no longer a controlled substance. Also, by amending schedule I to exclude THC in hemp, Congress has likewise removed THC in hemp from the CSA.”
Typically, cannabis plants can produce buds or flowers that have a high level of THC. Hemp plants tend to have very little THC in them. However, that doesn’t mean there is no THC or that the hemp plants couldn’t be modified to contain more THC.
Mark Singleton, the owner of Singleton Investments said, “This removes the argument of .3% THC.” He is referring to the designation that hemp-derived CBD is legal as long as there is less than .3% THC. If hemp THC is legal then it doesn’t matter whether it is .3% or not.
Let’s step back for a moment and review this .3% line in the sand for cannabis.
The .3% level is a designation for which there is little information as to how that number was determined. It is often referred to but there is little documentation as to how regulators arrived at that level.
One historian said that at one time a study was done to determine at which point people got high when consuming cannabis and that .3% was the midrange and thus it stuck. Some people needed less and some didn’t get buzzed until it was more than .3%, so the scientists just picked the middle point and called it a day. Random and possibly no longer true.
Anyway, there is some debate now over this USDA bulletin and whether the words “in hemp” mean THC can’t be extracted from hemp because then it would no longer be in the plant. Several people have suggested that the phrase hemp-derived products covers hemp extractions even if it includes THC. It’s a new bulletin and is sure to be tested very quickly.
Singleton believes that THC derived from hemp will quickly become popular and farmers will set up extraction facilities within their states and begin shipping across state lines. “It solves McConnell’s problem. He’s got the largest plant extraction facility in the entire country. Located in Kentucky,” said Singleton, who says he’s on McConnell’s speed dial.
If hemp-derived THC is now legal and can cross state lines, it will be close to impossible for law enforcement to determine the difference between cannabis-derived THC and hemp-derived THC. This USDA bulletin could have effectively descheduled cannabis. Singleton believes Congress will be forced to act quickly to legalize cannabis since the USDA has jumped the gun.
In May, New York Representative Hakeem Jeffries and Senator Chuck Schumer introduced a bill, HR2843, in both Houses removing cannabis from the CSA and it included a social justice component. “I believe this bill will have at least 100 co-sponsors by June 15 and has the best chance to get passed,” said Singleton. “If the Safe Banking Act doesn’t get passed first, then I think this one will. I know the cannabis industry wants the States Rights Act passed, but it’s going nowhere. These have the most support.”
Indeed, no one in the cannabis industry expected the USDA to be the ones to legalize THC and it looks as if this is the next domino to fall.
