The legalization of marijuana varies drastically between states, with some lawmakers approving its use entirely, others allowing its use only for medical conditions, and some still punishing possession of the drug by a prison sentence.

Thirty-eight states currently have it legalized for medical use, with 24 permitting recreational use, allowing many Americans to have access to marijuana, also known as weed, in one way or another if they are over the age of 21

While it is still illegal on a federal level, President Joe Biden has made it clear that his administration intends to pursue decriminalization during his time in office. Whether this is likely ahead of the looming election, however, appears questionable.

Since Colorado and Washington’s legalization of recreational marijuana in 2012, 22 other states, and Washington, D.C., have slowly amended their laws in favor of decriminalizing the substance.

Five more states could amend their laws soon: Wisconsin, Florida, Hawaii, South Dakota, and South Carolina.

Amid the arrival of “4/20” day—a celebration for cannabis smokers each year, on April 20—Newsweek looks at some of the states that could push ahead with legalizing use of marijuana in some way.

Florida

Florida voters will be able to decide if recreational use of marijuana should be legal in the state at the ballot in November.

Users will need to be 21 years or older to legally consume it. Medical marijuana is currently permitted.

Gov. Ron DeSantis has been one of the proposal’s most vocal critics, saying he believes recreational use of the drug should not be legal in the state

The law change will require a 60 percent approval for the amendment to pass when voters head to the polls in November.

Hawaii

A bill to legalize the recreational use of marijuana for adults in Hawaii was approved by the House Consumer Protection and Commerce Committee in March, raising hopes that laws could be extended from granting medical use.

The bill was earlier passed by the Hawaii Senate, and Gov. Josh Green, a Democrat, has indicated he would sign the bill into law once the House passes the second version.

The law would specifically allow anyone aged 21 and older to possess up to 1 ounce of marijuana and up to 5 grams of cannabis concentrates. Hawaiians would also be able to possess their own produce—up to six plants and up to 2 pounds of harvested marijuana.

It would also expunge the criminal record of past convictions related to cannabis possession.

South Dakota

South Dakotan law changes are less advanced down the legislative path than other states on this list but campaigning to legalize recreational use—as well as the already legal medical use—remains vocal.

The state has tried several times in the past to achieve this, including a 2020 election ballot from voters approving the law change. But the South Dakota Supreme Court shut down the approval as unconstitutional a year later.

Voters then rejected another initiative in 2022. Now campaigners are working again to put the question to the electorate in November, requiring almost 18,000 signatures by May.

Wisconsin

At the start of the year Wisconsin appeared the most likely of any state to decriminalize medical marijuana, but a Republican bill fell flat ahead of an official vote.

The state bill was being considered to legalize use of the substance, but this would have been limited to severely ill people and would only be dispensed from five locations around the state. It would have also ruled out the legalization of smokable marijuana.

Leaders of the Republican-controlled Senate and state Assembly have largely supported the legalization, while Democratic Gov. Tony Evers has also previously voiced support to permit medical marijuana.

Currently possession of the drug is illegal in Wisconsin. Depending on the quantity of the substance you are caught with, it is possible to go to prison or incur heavy fines.

Despite the bill failing, conversation of reform has still grown steadily—and, while the state may fall short of legalization this year, Wisconsin remains one of the most likely areas of the country to proceed with medical marijuana laws.

Announcing the bill was effectively dead earlier this year, however, Assembly Speaker Robin Vos did give legalization supporters hope when he announced a public hearing to build support for passage next session would ensue later this year.

South Carolina

The South Carolina Senate passed a bill in February to allow the use of marijuana and related products for medical needs. But the bill has now sat in the state’s House of Representatives for two months with little hope of being debated on the floor.

State lawmakers will need to get a move on, with just weeks left before the House adjourns. Anything that does not make it to the House will have to be proposed again next year.

This has been the case for several years, with an almost identical bill dying in the House in 2022. Many state senators have been working for almost a decade to change the law.

It would still be illegal to smoke the drug or use it recreationally under the new law. Patients could instead use vaporizers or patches to gain the medical benefits.

Any use of cannabis is currently illegal in the state and can carry a fine of up to $1,000 and even 30 days to six months in jail.

The recreational use of marijuana is legal in 24 states, and Washington, D.C., as of April 2024. While jurisdictions differ on the legal quantity allowed for legal possession, almost half of U.S. states have now approved its use.

These include Alaska; Arizona; California; Colorado; Connecticut; Delaware; Illinois; Maine; Maryland; Massachusetts; Michigan; Minnesota; Missouri; Montana; Nevada; New Jersey; New Mexico; New York; Ohio; Oregon; Rhode Island; Vermont; Virginia; and Washington.

Other states have pushed ahead with legislation approving the substance’s use for medical conditions. While the laws vary, these states include Alabama; Arkansas; Kentucky; Louisiana; Mississippi; New Hampshire; North Dakota; Oklahoma; Pennsylvania; South Dakota; Utah; and West Virginia.

Marijuana is effectively illegal in the remaining 11 states: Georgia; Idaho; Indiana; Iowa; Kansas; Nebraska; North Carolina; South Carolina; Tennessee; Texas; and Wyoming.

,” the new scientific publication presents the consumption trends observed in patients and the self-reported impacts of medical cannabis in alleviating their primary symptoms.

Nearly 54% of patients taking prescription opioids, reported a decrease in use over the past year with medical cannabis.

Tilray revealed in a Wednesday press release that those taking part in the study said cannabis had a “high degree of efficacy in alleviating their illness or symptoms,” with many emphasizing “a reduction in their use of prescription opioids, alcohol, tobacco, and other substances.”

“Our role in this initiative exemplifies our commitment to medical research, leading us one step closer to unlocking the full therapeutic potential of medical cannabis,” said José Tempero, Tilray’s medical director.

The latest results build on a growing body of research, which shows cannabis consumption among seniors is becoming more common. A recent study done at the University of Colorado Boulder, examined the effects of cannabis use in adults aged 60 to 88 with no history of alcohol or other substance use disorder. It showed that “low-dose, daily cannabis use after age 55 might effectively reduce the degenerative effects of chronic brain inflammation,” said Gary Wenk Ph.D., a scientist not involved in the study.

Americans appear to continue to see a need for change with U.S. cannabis laws. New research data from Pew found that an overwhelming 88% of U.S. adults say that cannabis should be legalized for medical or recreational use. 

Pew found that, in an environment where most Americans live in a state that has legalized the plant and products made from it for certain reasons, having exposure to at least one dispensary in their communities has opened more people up to the idea that total legalization would be OK, it seems.

The survey split up choices in various ways based on beliefs about how the plant should be used and was conducted between Jan. 16 and Jan. 21.

In survey data out this week, Pew found that almost 57% of Americans say they believe cannabis should be legal for both recreational and medical reasons, while 32% said cannabis should only be legalized for medical use.

One interesting aspect of the data is how Americans view the impact legalizing cannabis for recreational use might have on safety and encouraging the use of other substances.

29% of Americans said they believe cannabis increases the use of other drugs, while about the same — at 27% — said they believe it would decrease the use of other substances including cocaine, fentanyl and heroin. 42% said cannabis would have no impact on the use of other substances.

And when it comes to beliefs about safety in the community, 34% of Americans surveyed said legalizing cannabis makes communities less safe while 21% said legalizing cannabis makes communities safer.

And, beliefs about the legalization of cannabis were impacted by politics — the majority, 64%, of those who identify as a Democrat, or who lean towards being Democratic said the believe legalizing cannabis is good for local economies, and 58% said cannabis legalization creates a more fair justice system.

41% of Republican respondents said legalizing cannabis for recreational use has a positive impact on local economies, and 27% said legalization has a positive impact on the criminal justice system.

Those views were altered when age was factored in, with a majority 57% of Republicans between 18 to 29 years old who said they believe cannabis should be legalized for recreations and medical use — 52% of Republicans between 30 to 49 years old said the same.

Pew found that “wide majorities” of Republicans of all age groups favors cannabis legalization for medical use.

Across all racial and ethnic groups, Pew found that about 4 out of 10 U.S. adults believe cannabis legalization for recreational use makes the U.S. criminal justice system fairer.

For the study, Pew Research Center uses randomly selected U.S. adults who participate in self-administered web surveys. Pew said it used an oversample non-Hispanic Black men, Hispanic men and non-Hispanic Asian adults to “provide more precise” estimate of “opinions and experiences of these smaller demographic subgroups.”

In addition, a recent New York Times report looked at the uncertainty and desperation that fuels senior cannabis use, and how many are turning to it as a last resort for various ailments. Dr. Aaron Greenstein, a geriatric psychiatrist said, “People are just desperate. They’re willing to try anything.”

In short, though there may be medical applications for kratom, more research is needed to confirm the potential benefits of kratom in treating certain medical conditions.

While people have used kratom for centuries, including kratom tea, risks are associated with kratom use. Adverse effects of kratom intoxication include:

  • Neuropsychiatric symptoms, such as hallucinations, sedation, confusion, agitation, tremors, seizures, and coma

There is also the risk of becoming dependent on kratom. As with any unregulated substance, the FDA does not regulate kratom processing and sales, and there is a risk of buying kratom that’s been contaminated with harmful substances.

 

If you purchase kratom tea, be sure to get as much information as possible regarding how it was processed and where it came from. Note that it’s impossible to guarantee the safety of kratom tea leaves, and the short- and long-term safety effects of kratom are not well understood.

In its 2018 statement noting kratom’s potential for abuse, the FDA reported deaths that involved kratom use. Though the World Health Organization (WHO) notes that of the deaths where mitragynine (a compound in kratom) was confirmed, almost all the deaths involved the use of other substances, making kratom’s contribution to these deaths unclear.

Recent Sunspots are Increasing Activity, Intensity and will have Interference in Earth’s Geomagnetic Storms.

The sun has suddenly become much more active, bursting with sunspots and sending plumes of hot plasma out into space.

In the last week alone, sunspot numbers have increased by 10 times, dotting the sun’s surface with black pockmarks spewing out several coronal mass ejections every day.

 

One of these coronal mass ejections (CMEs) may be due to hit the Earth in the coming days, a NASA model has shown, with one possibly due to collide with our magnetic field and atmosphere late on November 25. This will be confirmed after scientists fully analyze the trajectories of the storms.

Coronal mass ejections are huge clouds of solar plasma that are spat out of the sun in regions of high magnetic activity, which can include sunspots. The sun may also send out solar flares, which are bright bursts of electromagnetic energy.

“Solar flares and CME are both caused by the sun through its magnetic field being twisted and stressed through motions in the sun,” Daniel Brown, an associate professor in astronomy and science communication at Nottingham Trent University in the U.K., told Newsweek. “However, a solar flare is the immense release of light triggered by the snapping and rearranging of the magnetic fields on the sun. That will go hand in hand typically with the release of a CME. But it will take a day or more for the particles to arrive while the light and radiation reaches us in just over 8 minutes. So, a good comparison is that a flare is the flash of a muzzle while the CME is actually the cannonball traveling and possibly hitting us.”

 

When the particles of a CME hit the Earth’s magnetic field and atmosphere, it can trigger a geomagnetic storm.

“A geomagnetic storm occurs when the Earth’s magnetic field is seriously disrupted by eruptions from the sun,” Huw Morgan, head of the Solar Physics group at Aberystwyth University in the U.K., told Newsweek. “When a large plasma storm erupts from the sun, and that storm carries a magnetic field which is oriented in an opposite direction to Earth’s magnetic field, we have a ‘perfect storm,’ and a larger geomagnetic storm.”

Geomagnetic storms vary in strength depending on the power of the CME that caused it, being measured on a scale between G1 (minor) to G5 (extreme), according to NOAA. The most powerful of the storms are the least common: while there may be 1700 G1 storms per 11-year solar cycle, we may only see 100 G4 storms and 4 G5 storms during that same period.

 

These geomagnetic storms can cause spectacular displays of aurora much further towards the equator than normal, with more powerful storms causing the northern lights to creep further and further south.

This occurs because charged particles in the Earth’s atmosphere are influenced and disturbed by the solar plasma hitting us, subsequently reacting with gases like nitrogen and oxygen in the air and causing them to glow.

“Under quiet conditions, charged particles (both from the solar wind and the ionosphere) can become trapped in the magnetosphere, happily bouncing from hemisphere-to-hemisphere, pole-to-pole. Under these circumstances, some of these charged particles will collide with upper atmospheric particles, causing auroras in the polar regions,” Brett Carter, an associate professor in space science at RMIT University in Australia, told Newsweek.

However, when a CME hits and causes a geomagnetic storm, these particles are forced deeper into the atmosphere, causing them to react with more gases and cause the aurora to be brighter and visible further.

Other than pretty lights in the sky, geomagnetic storms can also lead to some impacts on infrastructure, including fluctuations and outages in the power grid and radio blackouts.

“The affected infrastructure that is of most importance is large-scale power grids, without which modern society would not be able to function. Other than that, pipelines, High Frequency (HF) radio/radar and satellites in orbit are significantly affected,” Carter said. “Pipelines are known to also carry geomagnetically induced currents, which accelerates their corrosion. Satellites can experience increased surface charging due to the plasma environment in orbit, and this can affect the onboard electronics and operation of the satellite.

 

“Further, due to the huge amount of energy being dumped in the Earth’s atmosphere during these big storms, the atmosphere actually swells, and this causes more satellite drag in low-Earth orbit (up to about 1,000 km altitude, where the majority of our satellites are). Increased satellite drag further complicates efforts to keep track of everything in orbit, and making sure that collisions don’t take place. The really minor geomagnetic storm in February 2022 that resulted in the loss of the majority of a Starlink deployment is a perfect example of how varying satellite drag can complicate space operations.”

Scotts Miracle-Gro’s 2014 development of subsidiary Hawthorne Gardening Company “to meet the demands of hydroponic (cannabis) was considered one of the first large investments by a major U.S. corporation in the marijuana space. Nevertheless, Hagedorn wants to see the SAFE Banking Act passed for more than merely personal reasons.

It’s Not About Legal Pot

In an exclusive interview with Fox Business, Hagedorn pointed out that the idea behind the banking legislation is not to make pot legal but to allow businesses that represent the legal cannabis market to use banks, instead of having cash everywhere.

“It’s very dangerous. It’s inefficient. It’s really dysfunctional for the banking industry, not to be able to take this money in, allow people to deposit in, make capital investments in illegal businesses,” Hagedorn said.

The interview came on the heels of Senate Minority Leader Mitch McConnell calling the banking bill a “poison pill.”

It looks like the SAFE Act needs the support of both McConnell, and Senate Majority Leader Chuck Schumer, the reporter said and asked Hagedorn what he’d say to them if they were listening.

“Well, first of all, I think there are 60 votes to get this out of the Senate. It’s been passed multiple times on a bipartisan basis in the House with a lot of Republican support, and there are some really good people out there. The co-sponsor on the Republican side in the Senate is a guy named Steve Daines. He’s a really good Republican. I’m a Republican, out of Montana, and what he told me is – ‘Jim, I’m not in favor of marijuana,” Hagedorn said. “What I’m not in favor of is dysfunction and banking. In my state, by voter initiative, they made it legal. And if it’s going to be legal, my citizens should be able to bank.’”Tap to activate or exit full screen

Hagedorn continued. “This is not about pot. This is about dysfunction in banking, people today have to pay taxes on legal businesses with duffel bags of cash and counting machines like Scarface. It’s not the way it’s supposed to be in America. There are almost a half million people that are employed in this space. Americans that vote. They have problems getting mortgages this way. These are all people who are working in legal industries. This is dysfunctional and bad, and all the Senate has to do is allow legal businesses legal access to banking. “

Ifs the bill passes during the lame-duck session, Hagedorn says he doesn’t believe that big financial names like JP Morgan Chase (NYSE: JPM) and Fifth Third (NASDAQ: FITB), are going to embrace the industry in the same instant because there’s “a lot of sensitivity about compliance.”

While many believe the SAFE Act is a small step in much-needed marijuana reform, Hagedorn agreed with Senator Danes that it is indeed a big step forward in rationalizing banking for legal businesses.

“Let’s remember one thing when you have a lot of cash, it brings crime. There are people killed every day, where they have a lot of cash lying around. And people have to take this money in cash.”

UPDATE ON OMNIBUS SPENDING BILL

Marijuana advocates were given a massive setback after the Senate did not include a provision to remove federal restrictions on cannabis businesses from receiving banking services in the $1.7 trillion omnibus spending bill.

The provision, which would have been modeled after the House’s SAFE Banking Act, was excluded from the Senate’s spending bill, likely thanks to Senate Minority Leader Mitch McConnell (R-KY), who has been a fierce opponent of the legislation.

The CEO of the U.S. Cannabis Council, a pro-marijuana group, said of the provision’s exclusion, “To say that we are disappointed is an understatement.”

WASHINGTON–Today, the US Cannabis Council (USCC) named Khadijah Tribble, a leading figure in the cannabis reform movement and expert on equity and inclusion, as the organization’s CEO. Tribble succeeds Steven Hawkins, who led USCC since its founding in February 2021.

Tribble serves as Senior Vice President of Corporate Social Responsibility at USCC member company Curaleaf, a role she will continue in during her interim term as CEO. She previously founded Marijuana Matters, a cannabis education and advocacy incubator, and served as CEO of the Marijuana Policy Trust, which helps develop and run DEI programs in the cannabis industry. Tribble, who has advocated for fair and equitable policies on behalf of marginalized communities throughout her career, also serves on USCC’s DEI Task Force. She holds a master’s degree from Harvard University’s John F. Kennedy School of Government.

 

“The US Cannabis Council unites my deep commitment to cannabis legalization with my passion for addressing the harms of prohibition,” said Tribble. “My priority is advancing meaningful cannabis reforms through Congress this year that will provide the foundation for achieving our ultimate goal of federal descheduling while fostering an equitable and inclusive legal cannabis industry.”

 

Since launching last year, USCC has established itself as the leading voice for cannabis reform in Washington, DC. The organization has brought cannabis industry CEOs to meet with lawmakers in Congress, partnered with the sponsors of leading cannabis bills to advance reform and launched a campaign to advance passage of the SAFE Banking Act. Earlier this year, USCC launched its DEI Task Force with leaders in law, business and civil rights and partnered with the Congressional Black Caucus Foundation to create an internship program for Black college students and recent graduates at leading cannabis companies and organizations.
