US States legalizing recreational use represents the Restart of a Newly Energized Cannabis Movement in the United States.

Half of all U.S. states have fully legalized marijuana and there are only six states where it is fully illegal — Kansas, Idaho, Nebraska, Wyoming, North Carolina and South Carolina (though cannabis is decriminalized in North Carolina and Nebraska).

It’s a cultural shift that has been decades in the making.

California became the first state to experiment with legal cannabis when it made medicinal marijuana legal in 1996. Maine, Hawaii, Nevada and Colorado followed suit over the next five years, allowing their citizens to also purchase medical cannabis.

The U.S. government gives the Drug Enforcement agency over $3 billion a year to fight its war on drugs, so a state openly defying the government’s edict against the plant was extremely radical at the time.

But between then and now, there was nearly two decades on no movement on the issue as the United States’ archaic federal laws against the growth and distribution of cannabis held firm.

But then in 2014 Colorado and Washington took it a step further than California did and became the first states in the union to legalize the recreational use and sale of marijuana.

That year, about 22.2 million Americans aged 12 or older reported current cannabis use, according to aĀ national survey.

It turned out those two states legalizing recreational use represented the start of a newly energized cannabis movement in the United States. Since then, nearly two dozen states have also legalized recreational marijuana.

Washington and Colorado set the example

More than two-thirds of Americans polled by Gallup support legalizing marijuana. The 70% rate of support reached a record-high in October this year. Gallup has been issuing that cannabis poll since 1969.

Back then, just 12% of Americans admitted supporting the legalization of weed.

Gallup’s poll results also show the influence Colorado and Washington’s move to end prohibition in their states in 2014 helped spur the rapid adoption by the next 23 states.

While public support for cannabis legalization crossed the 50% mark for the first time in 2013, jumping up to 58% from 48% in 2012, it fell back down to 51% in 2014.

But since that year, support for legalizing marijuana has ballooned to the levels seen today.

“Although some health organizations and political commentators have raised concerns about the medical risks of marijuana, this hasn’t blunted the public’s desire for legalization thus far,” GallupĀ said.

“For now, the high level of support among younger adults suggests national backing will only expand in the years ahead, likely resulting in more states, and perhaps the federal government, moving to legalize it.”

Money is a major issue

If you think cannabis legislation moves slowly only at the federal level, you’d be wrong.

It took Hawaii, for instance, 20 years to graduate from legalizing medical marijuana — it was the first state to do so through a state legislature vote — to decriminalizing use of the plant in 2019.

While the journey has been long, the real inflection points for legalization came during the pandemic.

Shutting down the economy for over two years exposed and stressed many of the cracks in local economies that had been able to be hidden previously, and the money from taxes on cannabis (along with gambling) suddenly became more palatable for politicians who objected to legalization on moral grounds (see: John BoehnerĀ for reference).

Since 2020, Vermont, Arizona, Montana, New Jersey, South Dakota (later reversed by a circuit court judge) New York, Virginia, New Mexico, Connecticut, Rhode Island, Maryland, Missouri, Delaware, Minnesota, and Ohio have all legalized recreational marijuana.

Alabama, South Dakota, Mississippi (reversed by the Supreme Court of Mississippi) and Kentucky have legalized medical cannabis since then while Louisiana decriminalized the drug.

Maryland launched its adult-use cannabis industry in July this year and is seeing sales of $89.5 million a month. Thanks to the state’s 9% excise tax on adult use cannabis sales, the state has also received tens of millions of tax dollars it did not have access to last year.

So the economic case for legalizing cannabis is apparent for the states that are now participating. But for the rest of the country, it may take the federal government changing its laws in order for them to get on the cannabis train.

Illinois’ adult-use cannabis retailers reached a historic high in November, setting a record for the most legal cannabis sold primarily to in-state residents in a single month. Overall sales, including purchases made by out-of-stateĀ customers, ranked fifth-highest monthly total since weed shops opened in January 2020.

Breakdown of November’s Cannabis Sales

The IllinoisĀ Department of Financial and Professional RegulationĀ reported total recreational cannabis sales amounting to $139.1 million for the month.Ā AccordingĀ to Marijuana Moment, this figure includes $105.5 million in sales to Illinois residents and $33.6 million by visitors, exclusive of taxes.

Moreover, state-licensed retailersĀ soldĀ more individual adult-use cannabis products in November than ever before, with a total of 3.77 million items.

Medical Cannabis Sales and Market Trends

While the latest figures forĀ medicalĀ cannabis sales in November are still pending, October’s sales reached $26.2 million, including $12.4 million in dry flower and $13.8 million in concentrates and infused products. This data comes from theĀ Medical Cannabis Patient Program.

Despite these impressive numbers, Illinois consumers are facing higher cannabis prices compared to many other states with legal markets.Ā Governor J.B. PritzkerĀ acknowledged the high prices but emphasized the industry’s consistent expansion and the substantial sales to out-of-state customers.

2023: A Year Of Record-Breaking Growth

State officials also highlighted the ā€œunprecedentedā€ surge of state-legal cannabis sales in fiscal year 2023. This growth is partly attributed to the opening of 28 new retailers and total retail sales surpassing $1.5 billion.

The fiscal year 2023 brought approximately $451.9 million inĀ revenueĀ from legal cannabis to Illinois, outperforming alcohol revenue, which was around $316.3 million.

Advancing Social Equity in Cannabis Licensing

To address the impact of the War on Drugs, Illinois issued 200 conditional licenses and established aĀ Social Equity Criteria Lottery. This initiative aims to prioritize individuals disproportionatelyĀ affectedĀ by drug laws, with over 2,600 applicants for 55 new social equity dispensary licenses. Most of these new licenses were allocated in Cook County, the state’s most populous region.

A Boost to Diversity and Challenges for Small Growers

The industry has also seen a notableĀ increaseĀ in minority and women-owned businesses since 2020. Black-owned companies now account for 27% of the market, Latino/a or Hispanic-owned companies for 5%, Asian-owned companies for 3%, and women-owned businesses make up 16%.

However, small cannabis growers are facing challenges, struggling to thrive even with state aid.

Marijuana companies lay off hundreds, retrench amid economic woes

Women, minority execs show few gains in U.S. cannabis industry, according to the latest data from theĀ MJBizĀ Diversity, Inclusion and Equity Report.

While business around the world shuttered as COVID-19 spread, the marijuana industry was deemed ā€œessentialā€ in nearly 30 states and stood to gain from the pandemic.

But more than two years later, amid rising inflation andĀ fears of a recession, North American cannabis companies are cutting hundreds of jobs, closing retail outlets and cultivation facilities or shuttering altogether.

The marijuana industry mirrors mainstream companies that saw similar demand and now areĀ struggling to right-sizeĀ their businesses.

Sales of Peloton bikes spiked when gyms closed and people sought fitness alternatives; but the New York-based company has axed more than 4,000 jobs so far this year.

The pandemic-era e-commerce boom that boosted Shopify’s business also appears to have cooled, and the Canadian company, which makes the technology that powers online stores, has laid off about 1,000 workers.

The cannabis industry layoffs and retrenchment have affected plant-touching companies large and small as well as tech businesses such asĀ AkernaĀ of Colorado,Ā DutchieĀ of Oregon and delivery operator Eaze of California.

The factors behind the cannabis retrenchment are numerous. They include falling wholesale marijuana prices, cash-strapped consumers and structural changes affecting the industry, experts said.

Among the more notable plant-touching companies that have been caught up in the fallout in recent months:

  • California-based cannabis advertising giantĀ Weedmaps cut 10%Ā of its roughly 600-member workforce, citing market contractions in California, Colorado and Oklahoma.
  • Arizona medical marijuana growerĀ Nature AZ MedicineĀ laid off around 100 employees as medical sales drop and recreational sales spike.
  • Michigan-basedĀ Lume CannabisĀ closed four of its roughly 30 stores in the state but did say it plans to open three additional stores in more populated areas. The realignment, disclosed in July, comes at a time when marijuana prices inĀ Michigan have tumbledĀ because of market saturation.

Corporate turnarounds

In addition to inflation and economic woes, cannabis businesses are grappling with staffing issues.

For one, many public marijuana companies are undergoing turnarounds, which often translate into the shedding of employees.

ā€œThe guys who come in to handle turnarounds don’t understand the market and cannabis,ā€ said Avis Bulbulyan, CEO of Siva Enterprises, a California-based marijuana consulting firm.

Edmonton, Alberta-based Aurora Cannabis said in June that itĀ was cutting 12%Ā of its workforce as part of a corporate restructuring.

The company expects the move will save up to 90 million Canadian dollars ($69 million) and put it on the path to profitability. The company’s goal is to turn its first profit next year.

Another Canadian public company, Canopy Growth Corp., disclosed in August itĀ cut 245 employees – or about 8% of its workforce – as part of sweeping changes across the company designed to help stem recent losses and nudge the struggling producer to profitability.

Canopy said it expected the cuts and adjustments to generate up to CA$150 million in savings in 12-18 months.

Canopy alsoĀ closed its cultivation facilitiesĀ on 23 acres in Niagara-on-the-Lake, Ontario, last year.

Echoes of the dairy industry

ā€œThe legal cannabis business is volatile,ā€ said Daniel Sumner, professor of agricultural and resource economics at the University of California, Davis and co-author of ā€œCan Legal Weed Win? The Blunt Realities of Cannabis Economics.ā€

ā€œIt’s a new industry,ā€ he said, ā€œand companies are coming and going and being acquired in all parts of the industry – not just growing and processing and selling.ā€

Consolidation in the marijuana industry is similar to what happened to Wisconsin’s dairy industry, which lost 10% of its farms in 2019 and 44% over the past 10 years.

ā€œProduction went way up, but the number of farms went way down,ā€ Sumner said. ā€œIt’s consolidation. A lot of that consolidation means if you’re a manager, you call it labor-saving efficiencies.

ā€œBut if you’re a worker, you lost your job.ā€

Despite the cost of other products rising because of inflation, the price of marijuana has declined, another factor impacting companies’ ability to retain employees.

In Colorado, for example, the wholesaleĀ price per poundĀ of marijuana was $709 as of July 1 – an all-time low – and down 46% from $1,309 a year ago and nearly 60% from $1,721 in January 2021, according to Colorado Department of Revenue data.

ā€œFarm-level cannabis costs coming down is the reality of this business,ā€ Sumner said. ā€œIt’s partly improved management; some is technology.ā€

But, Sumner said, like other agricultural crops, price declines in the marijuana industry should be expected.

ā€œAdjusting for inflation, we now spend 10% of our income on food – not 4% like we did two generations ago – and there’s no reason to think cannabis won’t follow that trajectory.ā€

Ā Structural changes

And just as practices shifted from a customer-focused approach at grocery and liquor stores where someone would tell you about the products, practices at cannabis retail stores also are likely to see changes that result in the need for fewer employees.

ā€œEverybody used to buy their beef or their fish from the person who really knew beef and fish – you walked in and talked to the baker, the butcher or the fish monger about what you want,ā€ Sumner said.

ā€œThat’s the way it’s handled in cannabis now. But cannabis is moving away from it. It will be cheaper and more available, but there won’t be the services and employment.ā€

Like other industries, venture capital funding also has become scarce for cannabis businesses seeking investors to fuel their growth.

Without financing, it’s tough to keep as many employees as possible on staff, said Karson Humiston, founder and CEO of Denver-based cannabis recruiting network Vangst.

ā€œPeople are really tightening the belt and working to preserve cash because funding is hard to come by,ā€ Humiston said.

ā€œWhen companies have a harder time raising capital, they need to make sure they have enough cash to weather the storm. The first thing to go is expensive headcount.ā€

The majority of job cuts are at the senior level – not hourly employees who work in grows or retail shops, Humiston said.

And with many multistate operators using more gig employees than in the past, Vangst is having its busiest summer ever.

ā€œPeople are still purchasing and consuming cannabis, so these hourly workers are essential,ā€ she said.

ā€œCannabis still needs to be grown, packaged and delivered to customers. Those are hourly roles.ā€

Active Health Foods, Inc. announces joint venture with the Hub Craft, a licensed Massachusetts cannabis cultivator.

Cannabis Global in Distribution and Purchase Option Agreement for Cannabis Transport System Comply Bag(R)

LOS ANGELES, CA November 10, 2021 Cannabis Global, Inc. , an innovation-oriented company investing in disruptive cannabis technologies, today announces it has entered into a distribution agreement with Humboldt Bliss to distribute the Company’s Comply BagĀ®, cannabis transport system with integrated smartphone track and trace app.

As part of the agreement, the Company also also granted Humboldt Bliss an option to purchase a controlling interest in Ethos Technology LLC, dba Comply BagĀ®, a wholly-owned subsidiary of Cannabis Global, for $4 million, which controls the products and the associated intellectual property.

David Welch, the managing partner at DRWelch, a Los Angeles-based law firm specializing in regulatory compliance and intellectual property issues with a strong specialization in the cannabis industry, who serves as general counsel of Humboldt Bliss, commented, “We see strong possibilities relative to Comply BagĀ® especially relating to what most people in the cannabis industry believe will be an upcoming national market for cannabis. Comply BagĀ® is the best way to stop diversion of cannabis from the legal market into the illicit market and we believe likely to become a standard requirement for Government approved cannabis facilities.
