Current State Of CBD and Cosmetics in the USA

Watching Florida's Stop Light on Marijuana

Although the current state of regulation for CBD is in-flux for supplement and food products, the outlook is pretty good for beauty, as long as companies are careful about where they source the CBD, otherwise adhere to the regulations governing the marketing of cosmetic products, and limit sales to states where the sale of such products is legal.

While CBD Infused Beverages and Food Remains with the FDA. Cosmetic Use Is An Open Market Soon To Be Saturated.

  CBD, or Cannabidiol, is one of many cannabinoids found in the plant species Cannabis sativa L., which, surprising to many, includes marijuana and hemp.

December 2018 – The Farm Bill Legalized Hemp

The 2018 Farm Bill defines hemp as any part of the plant Cannabis sativa L. with a THC concentration of not more than 0.3% on a dry weight basis, and removes hemp and hemp derivatives from Schedule I of the Controlled Substances Act. CBD derived from a marijuana plant, or from a hemp plant with a THC concentration of greater than 0.3%, fall outside the statutory definition of hemp and therefore remain controlled substances. In order to legally market beauty products containing CBD, companies must be able to establish that the ingredient is derived from a hemp plant, grown by a licensed grower, and contains 0.3% or less THC. The United States Department of Agriculture, the regulatory agency responsible for implementing the 2018 Farm Bill, issued a legal opinion confirming that states may not prohibit the interstate transportation of hemp or hemp derived products that satisfy these requirements.

The Farm Bill does not, however, supplant the Food, Drug and Cosmetics Act (“Act”). Under the Act, companies that want to market beauty products containing CBD cannot claim the products, or the CBD, is intended to affect the structure or function of the body, or otherwise treat, mitigate, or prevent a disease. In addition to these Federal regulatory requirements, companies must also adhere to the laws of individual states, which have the right to restrict or limit the sale of CBD products within their jurisdictions. Thus, before shipping a CBD beauty product, companies should confirm the sale of such products is legal in the target state.

  Why is it crucial for CBD brands and ingredients providers to be completely up to date on the fast-changing regulations? The fast-changing regulations really have to do with growing and licensing requirements for hemp growers. The regulation of what constitutes legal hemp is pretty much set by the 2018 Farm Bill. Since CBD derived from hemp is the only ingredient that has been legalized by the Bill, it is critical for companies and ingredient suppliers to be sure (1) the hemp is sourced from a licensed grower, and (2) the THC content is 0.3% or lower.

3rd Party Certificates Of Analysis (COA) determine what is in the sample tested. Look for the Good and the Bad. *Pesticides, Heavy Metal or Added Toxins. COA’s are a necessity.

  Products that fail to meet these two requirements fall outside the statutory definition of hemp, fall within the definition of marijuana under the Controlled Substances Act, and are thus illegal.

Companies interested in marketing and selling CBD cosmetic products will gain insights into the regulatory landscape surrounding the marketing of such products, and in particular, have an understanding of the FDA’s and FTC’s current thinking and approach to regulating the products. Research strategies companies can follow to avoid attracting the attention of regulators and consumer lawyers.   What is the number one question that CBD beauty professionals have? There are really two questions to answer. The first is can we legally sell cosmetics containing CBD? The second question is what can I do to protect the company from claims arising from the sale of CBD beauty products. As noted in response to question 1) above, the question of legality is somewhat straightforward. The question of protection is more complex, and involves the need contract with vendors, secure insurance coverage, and consider a myriad of other business considerations.

180 Life Sciences Corp. has selected a lead synthetic CBD analogue that is expected to move forward in clinical development.

MENLO PARK, Calif., July 28, 2021 180 Life Sciences Corp, a clinical-stage biotechnology company focused on the development of novel drugs that fulfill unmet needs in inflammatory diseases, fibrosis and pain, announced today that it has selected a lead Synthetic CBD Analogue that is expected to move forward in clinical development for both inflammation and pain.

As part of a continuing collaboration since 1998 with the pioneer of cannabis chemistry, Raphi Mechoulam (Hebrew University, Jerusalem), Sir Marc Feldmann’s (the Company’s Co-Executive Chairman and Co-Founder) laboratory, and 180 Life Sciences’ scientists, identified the non-psychoactive CBD analogue as a lead molecule in the Company’s SCA platform.

The analog was selected based on a wide-ranging screen of derivatives of cannabidiol and cannabigerol made by Prof Mechoulam.

The Company believes that the analog appears to have (1) a novel composition of matter which would enable patent protection, (2) robust preclinical efficacy in several established mouse models for treating pain and inflammation in vivo , and (3) ease of scalability for future good manufacturing practice (GMP) manufacturing. Its safety profile is being explored in greater detail.

CBD Honey? No Really, May Bee the Solution.

In a new study published in the journal Environmental Entomology, researchers in the Department of Entomology at Cornell University in New York wondered if the growing legalization of cannabis for recreational, medical and industrial purposes is having any effect on bees.

While marijuana is becoming in New York, industrial hemp is a fast-growing industry and the flowers are essentially the same. In a simple test (repeat visits to New York hemp farms and collected bees with nets), the researchers found 16 different bee species happily buzzing around the buds.

That variety highlights the “species richness” of Cannabis sativa when it comes to attracting bees.

“Industrial hemp offers a unique floral resource to bees in agricultural landscapes. Hemp flowers late in the summer releasing an abundance of pollen during a period of native and agricultural floral dearth. As a result, hemp pollen may offer a vital subsistence resource to bees at a point in the season when they are resource-limited, thereby helping to alleviate the pressures imposed by spatial and temporal variation in resource availability that is characteristic of simplified agricultural landscapes.”

The researchers weren’t as concerned about the growing creation of cannabis honey (we know you are – hang on) as much as how the dominance of cannabis would affect the bees.

It turns out that besides being attractive to a diversity of bees, cannabis blossoms in the late summer when most other plants are finished and bees are looking for pollen. By extending their season, cannabis may actually be helping to strengthen the bees to fight off the diseases that have decimated their populations in recent years. What about the cannabis honey?

Right.

Most products labeled cannabis honey are actually infused with CBD or THC.

While beekeepers claim the honey from bees specializing in cannabis flowers contains cannabinoids, it’s tough to differentiate between benefits that might come from them and the natural benefits of honey.

The Israeli cannabis technology company PhytoPharma International is offering pure, non-infused, highly bioavailable cannabis-derived honey called Pure Bee.

It’s available in two forms — non-intoxicating CBD Honey and psychoactive THC Honey – and is said to take effect in 10 minutes, much faster than most edible cannabis products.

So, do bees really get a buzz from marijuana? Unfortunately, no. Bees lack cannabinoid receptors and merely pass them on to their honey.

They buzz the buds merely for the fun and the exercise.

“CBD is My Go To” say some 2020 Olympic Athletes

Effective Jan. 1, 2018, the World Anti-Doping Agency (WADA) removed CBD from its list of prohibited substances.


The change allowed athletes to incorporate CBD into their training regimes for the postponed 2020 Tokyo Olympic Games.

 

Competitors in the delayed 2020 Summer Games, including softball outfielder Hayley McCleney and hurdler Devon Allen, are among those who utilized CBD products in the runup to the Olympic competition.

 

Olympic gold medalists Megan Rapinoe and Sue Bird also use hemp-derived CBD for natural wellness solutions. “I use [CBD] right after training,” Rapinoe said. “It’s my go-to to calm me down after a hard training or game, as well as for sleep.”

 

The Summer Olympics were in Tokyo, Japan, through this past Sunday (National CBD Day in the USA) Aug. 8, 2021.

 

However, Japan’s strict anti-cannabis laws don’t permit athletes to take hemp products across international borders. “It’s quite frustrating that I can’t use them to compete on the world’s biggest stage,” Rapinoe said.

 

Attitudes about cannabis are shifting, and elite athletes are being more open about using cannabis to recover better, and stay on top of their game longer. U.S.

Senate Majority Leader Chuck Schumer recently introduced draft legislation to federally legalize cannabis.

 

The Cannabis Administration and Opportunity Act (CAOA) addresses several areas where the Federal Government lags behind individual states in recognizing the benefits of cannabis.

 

Proposals in the bill include removing cannabis from Schedule 1 of the Controlled Substances Act.

 

Support for legalization of cannabis has been growing rapidly in the United States since 2012.

House Appropriations Committee to Consider Hemp Guidelines this Summer.

Earlier this summer, representatives in the U.S. House began working to reconsider policies, extend compliance times and clarify regulations for hemp production and consumption in the United States.

On June 30, 2021, the House Appropriations Committee advanced several hemp-related legislative items. In a report issued by the committee, industrial hemp production and marketing was deemed “an especially important opportunity for rural communities.”

The same committee urged the U.S. Dept. of Agriculture (USDA) to clarify that hemp-related businesses should be eligible for all rural agricultural grants. “The intent of Congress in Public Law 115-334 was for industrial hemp to be eligible for all USDA programs, including Rural Development,” the committee report stated.

The report continues, “Industrial hemp can significantly benefit struggling rural economies. The Committee encourages Rural Development to ensure that industrial hemp is eligible for all competitive grant programs.” The committee also proposed a significant increase in agricultural funding with $16.7 million earmarked to support the federal hemp production program.

This is the same amount listed in the Fiscal Year 2022 budget proposed by Pres. Biden. The House Appropriations committee also included a recommendation to USDA and DEA for more clarification and coordination on the regulation of hemp extract.

The report stated that “the Committee directs USDA to coordinate directly with the DEA to present the industry with guidance and information on in-process extracted material” to address specific concerns brought up by hemp industry stakeholders.
