It’s cropping up in protein powders, bath salts, makeup and even jelly beans.

But scientists are still unsure of exactly what the benefits — and pitfalls — of CBD are. 

“Society has jumped way ahead of the science on this,” said Margaret Haney,

a professor of neurobiology at Columbia University Medical Center in New York.

Reported benefits have mostly been anecdotal, or they have come from studies involving animal models.

CBD isn’t well understood, nor have there been sufficient studies done in humans, she said.

 

 

Cannabis plants produce a group of chemical compounds called cannabinoids.

The best-known are tetrahydrocannabinol, or THC

(the so-called psychoactive component of the plant that’s associated with the marijuana “high”),

and CBD (a non-intoxicating component of the plant that doesn’t produce a high),

Here’s what we do know: CBD can help treat some types of pediatric seizures.

Last year, the FDA approved GW Pharmaceuticals PLC’s Epidiolex for the treatment of seizures associated with two rare forms of epilepsy in patients two years of age and older.

But, to get to that point, GW Pharmaceuticals had to go through a long and rigorous drug-approval process to show the drug’s safety and efficacy through clinical trials.

This hasn’t been done with CBD for any other indication, until now.

While it’s true that CBD has shown promise in pre-clinical and animal trials in addressing a number of issues such as pain, anxiety, neuroinflammation and substance-use disorder,

there’s still not nearly enough peer-reviewed research available, said Ziva Cooper, research director of the Cannabis Research Initiative at the University of California, Los Angeles.

To truly determine the effects of CBD in humans, many further studies need to be done — studies with humans, she said. “Overall, we have very little real data on the therapeutic effects of cannabidiol,” she said.

As for those CBD-based skin products that are popping up on shelves and online, Columbia University’s Haney said she remains skeptical of their marketed benefits.

Many are diluted. It’s a question of both dosage and absorption, she said. “We have no idea how much CBD you would need to rub on your skin for it to have some kind of medical effect,” she said.

 The amount of CBD in a lot of marketed products — even ones that are meant to be taken orally — is so small that we can not make any therapeutic measures for the person using it, said UCLA’s Cooper.

In the few studies that have involved humans, doses were in the hundreds of milligrams, but most CBD-infused products contain much less than that,

which the company says can be used as a daily supplement and help “promote a calm sense of well-being,” it also notes on its website that such statements “have not been evaluated by the Food and Drug Administration.”  

CBD advocates were hoping laws around the compound might loosen up — or at least become clearer — after President Donald Trump signed the 2018 Farm Bill.

The bill legalized hemp, a variety of the cannabis plant that contains no more than 0.3% THC.

But regulation of CBD, whether derived from hemp or not, is still largely under the FDA’s jurisdiction.

Since CBD is technically an active ingredient in an FDA-approved drug,

companies are not allowed to add it to food or drinks sold across state lines or to sell it as a dietary supplement.

 

Companies are, however, allowed to put the compound into beauty and skin-care products, as cosmetics are not subject to premarket approval by the FDA.

That could explain why drugstore chains like CVS and Walgreens aren’t worried about introducing CBD-infused topical products in their stores.

“People shouldn’t confuse availability with legality,” said former FDA regulatory counsel Jonathan Havens.

The agency has cracked down on unfounded claims, but it has limited resources and can’t get to everyone, so it is focusing mostly on companies making blatant health claims about their products, Havens said.

 

The FDA recently sent warning letters to Advanced Spine and Pain LLC, Nutra Pure LLC and PotNetwork Holdings,

saying the companies violated federal law by advertising their CBD-containing products as potential treatments for ailments including cancer, Alzheimer’s disease, arthritis and more. 

“The FDA wants to protect consumers. The last thing it wants is companies out there marketing CBD products and claiming health benefits without any clinical research to validate that,”

said Rob DiPisa, co-chair of the Cannabis Law Group at law firm Cole Schotz. 

US FDA Fight to Regulate Cannabis (Hemp) More Research is Needed

At the same time, requiring anyone who wants to put a CBD-containing food or beverage on the market to go through the clinical-trial process would “chill the whole CBD market,” he said.

  The FDA is aware of the public’s interest in CBD. Former FDA commissioner Scott Gottlieb put out a statement outlining steps to figure out a framework to lawfully market cannabis

and cannabis-derived products, including  public hearings and formed an internal working group to look into the issue.

DiPisa said he hopes the hearings last  May 2021 will provide more clarity for him and his clients.

“Everyone is running blind right now,” he said.

House Reintroduces SAFE Banking Act To Normalize Cannabis Commerce

In a letter to several members of the House Financial Services Committee today, the American Bankers Association expressed support for the SAFE Banking Act of 2021, which would provide a safe harbor for depository institutions seeking to serve legitimate cannabis-related businesses in states where such activity is legal.

On Thursday, The United States House of Representatives reintroduced a critical cannabis banking bill. Ed Perlmutter (D-CO), Steve Stivers (R-OH), Nydia Velazquez (D-NY), and Warren Davidson (R-OH) brought the SAFE banking act back to the House along with the support of over 100 additional cosponsors. The bill, which is expected to effortlessly advance, previously passed the house in 2019 and 2020 but was squashed by the Republican-controlled senate. However, now that Democrats control both the White House and Senate, the bill has a real chance of passing.

What Is The SAFE Banking Act? The Secure and Fair Enforcement (SAFE) Banking Act would allow legitimate cannabis businesses acting within the confines of the law access to the same banking services as other companies. Currently, despite the industry generating millions of dollars in tax revenue, cannabis entrepreneurs are seen more like criminals in the in the eyes of major financial institutions. Not only are cannabis operations effectively barred from traditional lending, but it’s also nearly impossible for these businesses to legally open a bank account. As a result, dispensaries and other cannabis businesses are obligated to deal primarily in cash-only transactions, making them prime targets for criminals. According to Representative Perlmutter, “Thousands of employees and businesses across this country have been forced to deal in piles of cash for far too long. It is the responsibility of Congress to step up and take action to align federal and state laws for the safety of our constituents and communities.” The bill remains largely the same as it was in 2019 and 2020, but with added language that explicitly includes hemp and hemp-derived CBD related businesses, which still struggle in accessing financial services despite the legalization of hemp in the 2018 Farm Bill. The current version of the bill has been updated slightly to include minor technical changes to the safe harbor, strengthened hemp provisions, and other technical updates.

The SAFE Banking Act’s Path Forward In 2019, The SAFE Banking Act was introduced as a stand-alone bill. Despite overwhelmingly passing the House, it would never see the Senate floor. A year later, House Democrats attempted to embed the bill in part of their larger Coronavirus relief package, pointing out the inherent dangers of operating an “essential business” in a cash-only capacity during the height of a catastrophic pandemic.

After considerable criticism from Republicans, the House eventually dropped the SAFE Banking Act from the relief bill’s final draft. Perlmutter harkened back to this subject in his Thursday address, saying, “In many states, the industry was deemed essential yet forced to continue to operate in all cash, adding a significant public health risk for businesses and their workers. As we begin our economic recovery, allowing cannabis businesses to access the banking system would also mean an influx of cash into the economy and the opportunity to create good-paying jobs.”

The Senate is expected to introduce its own version of the bill this week. For the last two years, this is where the SAFE Banking Act has predominantly run into challenges. However, this time around, the Senate has a more favorable makeup—split 50-50 between Republicans and Democrats, with Vice President Kamala Harris acting as the tiebreaker. Perlmutter remains optimistic the bill will make it all the way to President Biden’s desk. He said, “I think this is going to get a full legislative review, and we’re going to get a good product, a good piece of legislation, and send it to the White House.”

Smoking Ban Removal

Republican Senator Jeff Brandes‘ Bill SB 182 Medical Use of Marijuana and HB 7015, the House Health & Human Services Committee.

This bill plans to allow medical marijuana to be available in the form of smokeable flower for adults. Only minors who are terminally ill, with a recommendation from both a qualifying physician and a pediatrician will be the exception to the rule.

Retail Decoupling 

Senator Thurston’s SB 154 and Representative Thompson’s HB 461 – Retail Medical Marijuana Facilities.

“Revising definitions of the terms ‘edibles, ‘low-THC cannabis,’ ‘marijuana,’ and ‘marijuana delivery device’ to include items that are dispensed by a medical marijuana retail facility; defining the term ‘medical marijuana retail facility’; revising the definition of the term ‘medical use’ to include the use of marijuana dispensed by a medical marijuana retail facility; revising the definition of the term ‘physician certification’ to authorize a qualified patient to receive marijuana and a marijuana delivery device from a medical marijuana retail facility;  prohibiting qualified physicians and caregivers from being employed by or having an economic interest in a medical marijuana retail facility; requiring that the medical marijuana use registry maintained by the Department of Health be accessible to medical marijuana retail facilities for certain verification purposes, etc.”

Cannabis Banking 

Senator Taddeo’s SB 1116 and Representative Silvers’ HB 1119 – Banking Services for Medical Marijuana Treatment Centers.

This bill is to “Revise the definition of the term ‘financial institution’ to include a medical marijuana limited charter bank or credit union licensed under the Marijuana Limited Charter Banking and Credit Union Law. Providing a short title; defining terms; establishing the Medical Marijuana Limited Charter Bank and Credit Union Advisory Board within the Office of Financial Regulation.”

Out of State Patient Card Reciprocity 

Republican Representative Massullo’s HB 557and Republican Senator Albritton’s SB 1328 – Reciprocity for Medical Use of Marijuana.

According to the bill, “An act relating to reciprocity for the medical use of marijuana; providing that a qualified patient identification card or caregiver identification card, or its equivalent, issued by another state, United States territory, or the District of Columbia, has the same force and effect as a medical marijuana use registry identification card issued by the Department of Health, etc.”

Adult Use (Recreational) Marijuana 

Representative Grieco‘s HB 1117 and SenatorFarmer’s SB 1780 (co-introduced by Senator Bracy) – Adult Use Marijuana Legalization An act relating to “Adult Use Marijuana Legalization; Renaming the Division of Alcoholic Beverages and Tobacco of the Department of Business and Professional Regulation; exempting certain activities involving marijuana from use and possession offenses; authorizing persons age 21 and over to engage in certain activities involving personal use of marijuana in limited amounts; providing limits on where persons may engage in specified activities, etc.”

Marijuana Use Decriminalization 

Senator Pizzo‘s SB 1312 and RepresentativeJenne’s HB 1312 – Cannabis decriminalization

“An act relating to cannabis; providing reduced criminal penalties for distribution or possession of certain amounts of cannabis concentrate or THC in cannabis products or edibles, etc.”

Constitutional Amendment for Adult Use

Democratic Senator Bracy‘s SB 1298 – Adult Right to Cannabis This legislation is “a joint resolution proposing the creation of Section 28 of Article I of the State Constitution to establish the right of persons over a specified age in this state to possess, use, and cultivate cannabis.”
