Defense Bill Amendment Removed DOD CBD – Hemp Prohibition 3 Years Ago

 

Washington, DC—Rep. Tulsi Gabbard (HI-02), a senior member of the House Armed Services Committee,

secured the amendment to the annual national defense bill that would ensure that the U.S. Department of Defense

may not prohibit the possession, use, or consumption of hemp products — in compliance with applicable Federal, State, and local law — by servicemembers, back 3 years ago.

She joined Rep. Jerry Nadler (NY-10), Chair of the House Judiciary Committee, in introducing H.R.3884, the Marijuana Opportunity, Reinvestment, and Expungement (MORE) Act.

The bill was passed by the committee in November 2019. The bill outlined sweeping reforms, including decriminalizing marijuana, expunging prior convictions, authorizing a tax on its sale which would be reinvested in communities that have been harmed by the federal marijuana prohibition, and ensuring minority communities are equitably engaged in the cannabis economy.

This would apply to hemp that meets the Agricultural Marketing Act of 1946 definition (amended by the Agricultural Improvement Act of 2018).

The Gabbard amendment was included in the final version of the bill which passed, 295-125, and now goes to the Senate for consideration.

“There is great research being done around hemp, resulting in new products coming to market that are proven to help with ailments like insomnia, inflammation, chronic pain, epilepsy, Traumatic Brain Injury, Post-Traumatic Stress and more. Hemp products provide a form of treatment that serves as an alternative option for those who would rather pursue natural remedies rather than prescription drugs.

This amendment passed with strong bipartisan support, ensuring our servicemembers have access to the same over-the-counter products that Americans all across the country benefit from today,” said Rep. Tulsi Gabbard.

 

The 2018 Farm Bill, known as the Agricultural Improvement Act, legalized hemp, defined as cannabis (Cannabis sativa L.) and derivatives of cannabis with extremely low concentrations of the psychoactive compound delta-9-tetrahydrocannabinol (THC) (no more than 0.3 percent THC on a dry weight basis). Currently, many over-the-counter products are sold that meet these parameters.

Background: Rep. Tulsi Gabbard has long called for sensible marijuana policies as part of her ongoing commitment to common sense criminal justice reform.

She introduced bipartisan legislation with Rep. Don Young (AK-at large) — the Ending Federal Marijuana Prohibition Act (H.R. 1588) and the Marijuana Data Collection Act (H.R. 1587). H.R. 1588 would remove marijuana from the federal controlled substances list. H.R. 1587 would direct the National Academy of Sciences to study the effects of state legalized medicinal and adult-use marijuana programs from a variety of perspectives, including state revenues, public health, substance abuse and opioids, criminal justice, and employment.

She has called for closing the gaps between federal and state law to resolve current contradictions and provide legally abiding marijuana businesses with clear access to financial services.

She joined several of her colleagues to introduce the bipartisan Secure and Fair Enforcement Banking Act (H.R.1595) in March 2019, which was passed by the House in September 2019. The bill would help prevent federal banking regulators from penalizing depository institutions for providing banking services to a legitimate marijuana-related business.

And, to protect veterans engaged in the state-legalized cannabis industry, Rep. Gabbard sent a letter to VA Secretary Robert Wilkie in June 2019 to demand a correction of the VA’s denial of loan guarantee benefits to these veterans.

Advocates of the compound say it confers all sorts of health benefits,

from mitigating the symptoms of depression and anxiety to treating Glaucoma,

 

 

It’s cropping up in protein powders, bath salts, makeup and even jelly beans.

But scientists are still unsure of exactly what the benefits — and pitfalls — of CBD are. 

“Society has jumped way ahead of the science on this,” said Margaret Haney,

a professor of neurobiology at Columbia University Medical Center in New York.

Reported benefits have mostly been anecdotal, or they have come from studies involving animal models.

CBD isn’t well understood, nor have there been sufficient studies done in humans, she said.

 

 

Cannabis plants produce a group of chemical compounds called cannabinoids.

The best-known are tetrahydrocannabinol, or THC

(the so-called psychoactive component of the plant that’s associated with the marijuana “high”),

and CBD (a non-intoxicating component of the plant that doesn’t produce a high),

Here’s what we do know: CBD can help treat some types of pediatric seizures.

Last year, the FDA approved GW Pharmaceuticals PLC’s Epidiolex for the treatment of seizures associated with two rare forms of epilepsy in patients two years of age and older.

But, to get to that point, GW Pharmaceuticals had to go through a long and rigorous drug-approval process to show the drug’s safety and efficacy through clinical trials.

This hasn’t been done with CBD for any other indication, until now.

While it’s true that CBD has shown promise in pre-clinical and animal trials in addressing a number of issues such as pain, anxiety, neuroinflammation and substance-use disorder,

there’s still not nearly enough peer-reviewed research available, said Ziva Cooper, research director of the Cannabis Research Initiative at the University of California, Los Angeles.

To truly determine the effects of CBD in humans, many further studies need to be done — studies with humans, she said. “Overall, we have very little real data on the therapeutic effects of cannabidiol,” she said.

As for those CBD-based skin products that are popping up on shelves and online, Columbia University’s Haney said she remains skeptical of their marketed benefits.

Many are diluted. It’s a question of both dosage and absorption, she said. “We have no idea how much CBD you would need to rub on your skin for it to have some kind of medical effect,” she said.

 The amount of CBD in a lot of marketed products — even ones that are meant to be taken orally — is so small that we can not make any therapeutic measures for the person using it, said UCLA’s Cooper.

In the few studies that have involved humans, doses were in the hundreds of milligrams, but most CBD-infused products contain much less than that,

which the company says can be used as a daily supplement and help “promote a calm sense of well-being,” it also notes on its website that such statements “have not been evaluated by the Food and Drug Administration.”  

CBD advocates were hoping laws around the compound might loosen up — or at least become clearer — after President Donald Trump signed the 2018 Farm Bill.

But regulation of CBD, whether derived from hemp or not, is still largely under the FDA’s jurisdiction.

Since CBD is technically an active ingredient in an FDA-approved drug,

companies are not allowed to add it to food or drinks sold across state lines or to sell it as a dietary supplement.

 

Companies are, however, allowed to put the compound into beauty and skin-care products, as cosmetics are not subject to premarket approval by the FDA.

That could explain why drugstore chains like CVS and Walgreens aren’t worried about introducing CBD-infused topical products in their stores.

“People shouldn’t confuse availability with legality,” said former FDA regulatory counsel Jonathan Havens.

The agency has cracked down on unfounded claims, but it has limited resources and can’t get to everyone, so it is focusing mostly on companies making blatant health claims about their products, Havens said.

 

The FDA recently sent warning letters to Advanced Spine and Pain LLC, Nutra Pure LLC and PotNetwork Holdings,

saying the companies violated federal law by advertising their CBD-containing products as potential treatments for ailments including cancer, Alzheimer’s disease, arthritis and more. 

“The FDA wants to protect consumers. The last thing it wants is companies out there marketing CBD products and claiming health benefits without any clinical research to validate that,”

said Rob DiPisa, co-chair of the Cannabis Law Group at law firm Cole Schotz. 

US FDA Fight to Regulate Cannabis (Hemp) More Research is Needed

At the same time, requiring anyone who wants to put a CBD-containing food or beverage on the market to go through the clinical-trial process would “chill the whole CBD market,” he said.

  The FDA is aware of the public’s interest in CBD. Former FDA commissioner Scott Gottlieb put out a statement outlining steps to figure out a framework to lawfully market cannabis

and cannabis-derived products, including  public hearings and formed an internal working group to look into the issue.

DiPisa said he hopes the hearings last  May 2021 will provide more clarity for him and his clients.

“Everyone is running blind right now,” he said.

“Hempy 1st Anniversary” Florida! July 1st, 2020



It is hard to believe that it has been only One Year since the full Legalization of CDB in the USA.

Depending on where you live, you may have started to see “CBD” products – capsules, tinctures, salves – pop up in your natural food stores or even at the supermarket. With all the misinformation out there, you may have questions about the health benefits of this non-psychotropic medicinal as well as its different forms and delivery methods. Understanding how CBD works and what’s available can steer you toward a product that works best for your individual needs.

Wide-Ranging Benefits

CBD, aka cannabidiol, is a compound found in the cannabis plant, but unlike THC, CBD is non-psychoactive and non-intoxicating, meaning there’s no “high” associated with it, making it much more tolerable for a wider variety of people and the reason it has received so much attention as of late.

While the FDA does not allow companies to make health claims about CBD products, there’s enough anecdotal evidence to suggest it can be a very effective, natural medicine.

For example, the Medical Board of California’s “Guidelines for the Recommendation of Cannabis for Medical Purposes” names medical conditions including cancer, anorexia, AID’s, chronic pain, spasticity, arthritis, and migraines as conditions that respond well to cannabis treatments.

So, why is CBD so effective in treating such a wide array of conditions? CBD acts as a regulator of the endocannabinoid system (ECS), a communications system in the brain and body that plays a pivotal role in homeostasis. Homeostasis helps to regulate vital functions in the body like the immune, digestive, central nervous, and cardiovascular systems. The EC system, therefore, plays an important role in body functions like sleep, perception of pain, metabolism, cognition, and pleasure, and CBD helps modulate these functions. The list of conditions CBD may treat continues to grow, but the following have the most anecdotal evidence.

Sleep

CBD improves the quality of sleep by helping people fall asleep and stay asleep. While it’s been shown to assist with sleeping disorders like insomnia, it also alleviates the symptoms that disturb a good night’s sleep, such as stress, anxiety, and restlessness.

Pain Management

Because CBD is an anti-inflammatory, it’s great for pain, especially with conditions like arthritis, fibromyalgia, migraines, cramps, and even gut-related disorders like colitis and Crohn’s disease. A 2012 study published in the Journal of Experimental Medicine found that CBD significantly reduced chronic inflammation and neuropathic pain in animals. If you have chronic pain, consider a regular CBD regimen as this will likely prove more effective than just taking it once in a while.

Stress, Anxiety, and Depression

CBD calms the body and mind, alleviating stress and stress-related disorders, improving cognitive functions and mood, reducing anxiety (general, social anxiety disorder, obsessive-compulsive disorder), trauma-related disorders like PTSD, and depression.

Neurological Conditions

There is strong scientific evidence that CBD effectively treats neurological conditions like Alzheimer’s disease, Parkinson’s, multiple sclerosis, and epilepsy. For example, well-known documented cases if CBD shows it reducing the severity and number of seizures in children who were previously unresponsive to anti-seizure medications. The CBD-heavy cannabis strain “Charlotte’s Web” was created specifically for Charlotte Figi, who was diagnosed with Dravet Syndrome, a rare and severe form of epilepsy that was causing her to have 300 grand mal seizures a week.

Cancer-Related Symptoms

This includes nausea, vomiting, and lack of appetite associated with chemotherapy, as well as pain. Although more research needs to be conducted, CBD used in combination with chemotherapy could assist in combating cancer cells and suppressing cancer cell growth overall.

Hemp – vs. Cannabis-Extracted CBD

Depending on where you live, you have two CBD choices: CBD derived from hemp or CBD derived from THC.

CBD can be extracted from cannabis and hemp, and there’s a reason why that matters. If you were to see a cannabis plant and a hemp plant next to each other, you’d be hard-pressed to tell the difference. They look the same because they come from the same plant species: Cannabis sativa. The difference is that in order for a plant to be classified as “hemp,” it has to be bred to contain very low levels of THC, the principal psychoactive constituent of cannabis {i.e., what causes a “high”} – less than .3 percent to be exact. When CBD is derived from hemp, there are only minute traces of THC, whereas CBD that comes from cannabis can have larger amounts of THC present. If you are sensitive to THC or you don’t want to experience possible psychoactive effects, you’re better off sticking with hemp-derived CBD. But if you’re not sensitive to a little THC, there are benefits to cannabis-derived CBD.

Hemp-Derived CBD

The 2018 Farm Bill legalized the cultivation of hemp, removing hemp and hemp-derived products from its former Schedule 1 status within the Controlled Substance Act, making CBD derived from hemp federally legal in the U.S. so that it’s accessible to anyone that wants to try it.

At your local health food store, you’ll typically find CBD oil, capsules, tinctures, salves, and edibles like chocolate. The dosage of these products varies, and where to start depends on your tolerance and ailment. Taking 10-25 mg of CBD is a great place to stat for newbies. If you’re especially sensitive to medications you may wish to start at 5 – you may not feel the effects of the medicine, but it will provide a gauge for how your body will respond.

Once you’ve experimented a bit with the options, you may wish to branch out. You can go online and search “hemp-derived CBD products” and find a multitude of choices, but here’s where things get a bit tricky. While the FDA has regulatory authority over CBD, it has not established any definitive set of rules for the industry other than barring cannabidiol products from being sold as dietary supplements. As a result, there are serious quality control issues in the market at the moment.
