Steven Smith is a veteran entrepreneur and innovator who has been involved in the hemp and cannabis industry for over a decade. Marijuana in Florida is illegal for recreational use, but legal for medical use for patients with qualifying conditions. The state legalized medical marijuana in 2016, after voters approved Amendment 2, which expanded the list of qualifying conditions and allowed for more dispensaries and products. As of June 2021, there were over 600,000 registered medical marijuana patients and over 300 licensed dispensaries in Florida⁵⁶

However, recreational marijuana remains prohibited in Florida, and the penalties for possession vary by the amount, from financial fines to jail time. The state has not yet passed any laws to decriminalize or legalize recreational marijuana, despite several attempts by activists and lawmakers. In 2020, a proposed constitutional amendment to legalize recreational marijuana failed to gather enough signatures to qualify for the ballot. In 2021, another proposed amendment, backed by Trulieve, one of the largest medical marijuana providers in Florida, received enough signatures to qualify for the 2024 ballot. However, the amendment is facing legal challenges from the Florida Attorney General, who argues that the amendment is misleading and violates the single-subject rule.

Florida Amendment 3, the Marijuana Legalization Initiative, is on the ballot in Florida as an initiated constitutional amendment on November 5, 2024.

The initiative would legalize recreational marijuana for adults 21 years old and older. Individuals would be allowed to possess up to three ounces of marijuana (about 85 grams), with up to five grams in the form of concentrate. Existing Medical Marijuana Treatment Centers would be authorized under the initiative to sell marijuana to adults for personal use. The Florida State Legislature could provide by state law for the licensure of entities other than existing Medical Marijuana Treatment Centers to cultivate and sell marijuana products.^[1]

Medical marijuana was adopted by Florida voters in 2016 by a vote of 71% to 29%.

Smart and Safe Florida is sponsoring the initiative. The campaign reported $61.28 million in contributions. Trulieve, a marijuana dispensary company that owns medical marijuana dispensaries in Florida, is the main contributor.^[2] Smart & Safe Florida said, “The industry is sustainable and growing. In 2020, when the state lost more than 400,000 jobs, Florida’s cannabis industry added 15,000 employees. … Tax revenues from the legal cannabis industry for federal and state governments are projected to reach $4.06 billion in 2025, according to New Frontier data. … There is no evidence that legalizing marijuana for medical or recreational use at the state level, as 37 states already have done, has boosted underage consumption from the regulated marketplace. The continued black market sale of marijuana perpetuates a culture of criminality. … If adult-use cannabis is legalized, Florida users will have accountability, transparency, and regulations in place to ensure products are not laced with or contain potentially deadly chemicals.”^[3]

Vote No on 3, Floridians Against Recreational Marijuana, and the Florida Freedom Fund registered to oppose the initiative. Together, the committees reported $125,200 in contributions. The Florida Freedom Fund was created by Florida Governor Ron DeSantis (R) to oppose the marijuana initiative as well as the abortion initiative. DeSantis said, “[The initiatives] are very, very extreme. Once voters figure out how radical both of those are, they’re going to fail. It’s basically a license to have it anywhere you want. So no time, place and manner restrictions. This state will start to smell like marijuana in our cities and towns.”^[4]

According to a recent poll, 60 percent of Florida voters approve of legalizing recreational marijuana, while 34 percent oppose it, and 6 percent are undecided. The poll also found that support for legalization varies by age, gender, party affiliation, and region. Younger, female, Democratic, and urban voters are more likely to support legalization than older, male, Republican, and rural voters¹⁰

MJBizCon, the oldest and largest trade show in the cannabis industry, officially opens Wednesday amid growing economic challenges and renewed hope that federal marijuana reform will help the industry in the wake of this month’s midterm elections.

Now in its 11^th year, MJBizCon runs through Friday and features more than 1,400 exhibitors, 70-plus hours of educational content and 180 speakers.

More than 380 exhibiting companies are new to the showcase this year.

The expo hall, the largest in MJBizCon history, spans nearly 280,000 square feet on two floors of the Las Vegas Convention Center’s South Hall.

It’s where tens of thousands of cannabis industry professionals will convene for networking, startup funding, strategic partnerships, insights on regulatory reform and the political landscape and other topics.

High Roller

This year’s event arrives amid another critical juncture for the industry.

Cannabis companies, like others in mainstream sectors, are laying off workers and implementing other cost-cutting measures as prices for wholesale marijuana fall and recessionary concerns rise.

Meanwhile, the Biden administration has set in motion a process that could lead to revolutionary changes for federal marijuana policy.

The midterm elections, which often highlight the nation’s political polarities, provided a mixed bag of results on the marijuana front.

Among the many changes this year at MJBizCon, a new design divides the exhibition floor space into four distinct pavilions to help attendees find what they need:

Cultivation products and services.
Processing, packaging and lab services.
Retail and dispensary.
Business services.

“We can’t wait for everyone to see what’s new at MJBizCon – new exhibitors, a reorganized show floor, an outdoor patio,” said Jess Tyler, MJBiz’s senior vice president for events and sales.

The Story of Why There is a National CBD Day

National CBD day is a relatively new holiday. It is perhaps inevitable that advocates of the cannabinoid would look to celebrate it. After all, there are many other days throughout the year associated with cannabis.

These include April 20 (the famous 420 Day) and National Cannabis Oil Day, which falls on July 10. It is also called 710 Day.

It seems that 4-20 4:20 4/20 (MJ) and the Storyline behind it’s origin are all in everyday 420 News “High” lights.

On the the other side of our cannabis culture , did you know that the popular Marijuana’s’ co-species counterpart, Cannabinol or “CBD” has itself a National CBD (Hemp) Day?

Just how did there become a National CBD Day?

Well, a North Carolina CBD company CbdMD

achieved that in 2018.

In fact, the company also successfully lobbied for a National Hemp Day, which just saw its inaugural celebration on February 4.

CbdMD president Caryn Dunayer says both efforts were inspired by the lack of marketing and advertising available to hemp and CBD companies, which can be ostracized by media platforms and regulators because of their association with marijuana.

“We’ve tried to be strategic and creative in the marketing side,” Dunayer says. “In the cannabis industry, it’s extremely challenging to find traditional marketing. We can’t do SEO [search engine optimization] and social media, so we’ve kind of taken a guerrilla marketing approach. It started with that approach, and then the whole methodology after was trying to get attention to the education side.”

If it’s on a hot dog, then it’s American.

The CBD industry seems to agree with the marketing-before-education approach, with a mountain of deals and promotions offered today,

August 8, in honor of National CBD Day.

However, CBD’s legal status with the federal government isn’t solidified yet, and hemp was just legalized federally in late 2018.

The United States Food and Drug Administration still keeps CBD derived from hemp in a gray area, but considers ingestible products containing CBD illegal, including edibles, drinks and vaporizers.

CBD products face heavy scrutiny outside of states like Colorado, which have legalized recreational marijuana and hemp-infused foods, but that hasn’t stopped companies from making and marketing them, and those companies generally remain out of trouble as long as they don’t make any unsubstantiated health claims about the products. “We try to be as conservative as possible with claims and testimonials, and let real stories talk for themselves,”

Dunayer says. “We saw the value in how much creating a day like this could help the industry. And on the marketing side, selfishly, we can take a little credit.”

For Anderson and his organization, most of the criteria for adding a day comes from society’s acceptance, though he insists that the National Day Calendar committee did its due diligence when considering CBD’s medical efficacy and the reputation of the petitioner, CbdMD.

His organization has only created 200 days during its six and a half years, he says, so it didn’t take adding CBD or hemp lightly.

“There are about 20,000 applications for new days every year. Then there’s a committee of four people who review them, and that needs unanimous approval. Socially, it’s all becoming more accepted, even THC.

But CBD has additional purposes, so it was more about bringing about the awareness,” Anderson says, adding that he looked into National CBD Day’s application himself.

“They do tend to end up where the money leads, but it’s not always that way. Some of them are for the good for the world.

With that said, if you’re going to celebrate a national day about something, then celebrate with it.” Along with celebratory product promotion, Dunayer says that CbdMD will post educational content on its website and social media as part of its National CBD Day campaign.

Colorado companies are doing much of the same. In fact, they already view other national days as opportunities for connecting with customers. “We’re always looking for ways to amplify the message and reach different people to expand the education of CBD,” says Stratos CBD branding executive Kate Heckman.

Stratos has also looked at National Grandparents Day and National Massage Therapy Awareness Week to further promote the brand, she notes, suggesting that other companies in the CBD space should do the same.

“It’s sort of an American thing to commercialize it, but it’s also a reason to educate,” she concludes

Cannabis Global in Definitive Agreement to Acquire Caliwanna

Cannabis Freedom Alliance Releases New White Paper on Federal Regulation of Cannabis in a Legalized Environment Cannabis Freedom Alliance (CFA), a coalition of prominent national advocacy and business organizations seeking to end the prohibition and criminalization of cannabis in the United States, released a White Paper that provides an overview and general recommendations to help guide the effort toward federal legalization of cannabis. UPDATED NEWS ON Pennsylvania MMJ Cultivation Two state senators announced plans this week to introduce legislation that would allow Pennsylvania medical marijuana patients to grow their own plants at home. Sens. Dan Laughlin, R-Erie, and Sharif Street, D-Philadelphia, said they will co-sponsor legislation to allow Pennsylvanians in the state’s medical marijuana program (MMJ) to cultivate a limited number of cannabis plants from their home for personal use. “Pennsylvania’s MMJ Advisory Board and the state Health Department have mounting data illustrating significant disparities in accessibility,” Laughlin said.

“Cost has likewise been a big burden for patients for quite some time.” Pennsylvania approved medical marijuana with Act 16 in 2016, but patients in some rural counties must travel more than two hours to purchase flower at a dispensary. Patients also have complained products at the dispensaries are very expensive, particularly for cancer and terminally ill patients who do not have insurance coverage for the medicine they need. “It is critical that policy meet people where they are, and by allowing medical marijuana patients to grow cannabis plants at home, we can help ease the cost and accessibility burdens for this important medicine,” Laughlin said.

“This legislation would go a long way towards helping everyday Pennsylvanians meet their health needs and ensuring everyone is treated equitably and fairly under Act 16.” Laughlin and Street posted a memorandum Wednesday on the Pennsylvania state Senate website to solicit co-sponsors for the legislation. The Marijuana Policy Project, a nonprofit that advocates for marijuana policy reform, reports about half of the states with medical marijuana programs, and 15 of 19 states that have legalized adult-use cannabis, currently allow for personal cultivation. The Marijuana Policy Project contends in states with safeguards in place, such as a limit on plant numbers and requirements to keep grows out of public view, there have been no serious issues. No states have repealed home cultivation, and none is attempting to do so, according to the nonprofit.

The senators’ announcement came just over a month after Laughlin and Street introduced legislation to allow for adult use of marijuana in Pennsylvania. Senate Bill 473 would allow for personal use of marijuana, establish a Cannabis Regulatory Control Board, provide for regulating marijuana businesses, help those convicted of marijuana related crimes to expunge their records and incorporate the changes into current laws regarding driving under the influence. Laughlin and Street said more than 60% of Pennsylvanians support adult-use marijuana legislation, which the Pennsylvania Independent Fiscal Office estimated would generate between $400 million and $1 billion a year in new tax revenue for the commonwealth. Pennsylvania State Police arrested more than 20,000 adults for marijuana-relation violations in 2020, an increase from 2019, the senators said. Federal lawmakers, meanwhile, also have moved to decriminalize marijuana nationally.

U.S. Rep. Nancy Mace, R-S.C., introduced legislation Monday to decriminalize marijuana and allow states to pass laws and regulations without fear of federal intrusion. Mace told reporters at a Washington news conference a half-dozen of her Republican colleagues plan to co-sponsor the bill she said would regulate marijuana in the same way as alcohol, prohibiting use for anyone under 21, The Associated Press reported. If approved, Mace said, the measure would not change local marijuana restrictions and regulations already adopted by states. “It protects each state’s unique laws and reforms,” she said.

“It takes into account at the federal level that every state is different.” The National Conference of State Legislatures has reported 36 states and four territories have approved medical marijuana use. Eighteen states, two territories and the District of Columbia.
