2 New States Voted to Legalize Marijuana in the 2022 Elections.

Maryland and Missouri.

Alaska, Now Lighting Up

Adults 21 and over can light up in Alaska. In 2015, the northernmost US state made it legal for residents to use, possess, and transport up to an ounce of marijuana — roughly a sandwich bag full — for recreational use. The first pot shop opened for business in 2016.

Alaska has pounced on the opportunity to make its recreational-pot shops a destination for tourists. More than 2 million people visit Alaska annually and spend $2 billion.

Tuesday was a good day for stoners in Maryland and Missouri, as voters approved legalizing recreational marijuana in both places. The two states, which had already legalized medical use, join 19 other states (and D.C.) in making recreational use legal.

In Maryland, there’s a bit of a transitional period (which the Associated Press runs through here). Adult recreational marijuana use will not be legal officially until July 1, 2023, pending the General Assembly passing laws about how to appropriately distribute, regulate, and tax the plant. The Washington Post also notes that effective July 1, adults can grow up “up to two cannabis plants in their home, out of the public view.”

Past marijuana charges in Maryland will also be expunged, thanks to a companion bill passed in the spring that included both a provision to automatically expunge all cases in which possession was the sole charge. It will also allow individuals incarcerated for possession to petition for resentencing. At the time, many local politicians criticized the bill, emphasizing it would do little to nothing to prevent and reduce racial disparities and arrests in marijuana possession.

Bud was on the ballot in three other states. Voters in North Dakota, South Dakota, and Arkansas said no to the drug.

In other news, Coloradans voted on the decriminalization and regulation of psychedelic mushrooms. It’s still too close to call—with 80 percent of votes counted as of this writing, decriminalization leads 51-49 percent. Colorado would be the second state after Oregon to do so. One could say the state is leaning [looks up the color of magic mushrooms] brown?

The Amount of Misinformation about CBD is ASTOUNDING! Gives Pause to the Real “Stuff”.

Over the past few years, CBD has taken the world by storm. Daily, I see claims that CBD “cures” a myriad of ills.

As a holistic nurse practitioner and certified herbalist for more than 30 years, those exaggerated claims “push my buttons”, for a variety of reasons.

How Do Cannabinoids Work?

We all have an Endocannabinoid System (ECS), and it is just as important as our Respiratory System, Cardiovascular System, or Immune System. The ECS is the “orchestra conductor” of the body.

It regulates multiple systems to achieve balance and harmony. The ECS operates behind the scenes to support the wisdom of every cell of the body and coordinate the functions of cells, tissues, glands and organs. (3, 4)

The ECS has three primary functions (2):

To balance hormones (sex hormones, thyroid hormones, stress hormones) for calm, relaxation, healthy metabolism & healthy stress response

To balance brain chemistry for optimal learning, focus, memory, concentration, mood, and restorative sleep

To support healthy cell function, including modulating inflammation and healthy immune response

Where Do Cannabinoids Come From?

Cannabinoids are not foreign to the human body. We manufacture them internally. (Endogenous cannabinoids are even found in human breast milk.) The issue is that our native cannabinoids are used up quickly when under physical or emotional stress. Supplemental plant-based cannabinoids attach to the same cell receptors in our bodies to support our innate ECS in performing its vital functions. They are a healthy insurance policy.

Several well-known plants contain cannabinoids. We automatically think of cannabis, since it is the richest source of these compounds. Both hemp and marijuana contain an assortment of cannabinoids, but marijuana is much higher in THC, the psychoactive molecule that makes you “high”. Hemp contains higher levels of CBD and other therapeutic compounds and extremely low levels of THC.

Additional plant sources of cannabinoids include well known plants like sunflowers, echinacea, black truffles, black pepper, and cacao.

You need to know that cannabidiol (CBD) is just one of approximately 400 therapeutic compounds found in the cannabis plant. CBD is extremely popular, but often misunderstood. The amount of misinformation about CBD is astounding!

Let’s take a look at the FACTS:

The cannabis family includes both hemp and marijuana. Marijuana contains a much higher percentage of THC, a psychoactive compound that can make you “high.” Depending on the variety, marijuana may contain anywhere from 5% to 30% THC. The average is about 12%.

By law, industrial hemp can only contain up to 0.3% THC (3 parts per 1,000). Hempsmart’s CBD based products are all derived from organically grown premium hemp.

CBD Isolate contains only the CBD molecule from the hemp plant. That single molecule is extracted from approximately 400 therapeutic compounds naturally found in hemp. It has some therapeutic effects, but only a small fraction of the entire plant’s potential benefits. Mother Nature has assembled a rich blend of synergistic plant compounds in the hemp plant. This full array of plant components works synergistically to support the ECS. The important Entourage Effect exists with full spectrum CBD. The downside is that full spectrum compounds contain the psychoactive component, THC.

It is true that THC has some beneficial effects, but some individuals should NOT use THC. Children, seniors, individuals with certain medical conditions, and those who are required to be drug tested, should avoid THC unless there is a specific indication for using that compound. Drug testing is designed to detect the breakdown products of THC, specifically. THC may also cloud mental acuity, even in small amounts. If you are looking for comprehensive support of your health, without the potential side effects of THC, then a premium quality broad spectrum hemp extract will best meet your needs.

Broad Spectrum CBD (more accurately, broad spectrum hemp extract) can provide the best of both worlds – the important benefit of the Entourage Effect without the potential problems sometimes associated with THC. Broad Spectrum formulas generally omit the THC that can cloud mental acuity in some individuals and may also show up on a drug test.

Defense Bill Amendment Removed DOD CBD – Hemp Prohibition 3 Years Ago

Washington, DC—Rep. Tulsi Gabbard (HI-02), a senior member of the House Armed Services Committee,

secured the amendment to the annual national defense bill that would ensure that the U.S. Department of Defense

may not prohibit the possession, use, or consumption of hemp products — in compliance with applicable Federal, State, and local law — by servicemembers, back 3 years ago.

S he joined Rep. Jerry Nadler (NY-10), Chair of the House Judiciary Committee, in introducing H.R.3884, the Marijuana Opportunity, Reinvestment, and Expungement (MORE) Act.

The bill was passed by the committee in November 2019. The bill outlined sweeping reforms, including decriminalizing marijuana, expunging prior convictions, authorizing a tax on its sale which would be reinvested in communities that have been harmed by the federal marijuana prohibition, and ensuring minority communities are equitably engaged in the cannabis economy.

This would apply to hemp that meets the Agricultural Marketing Act of 1946 definition (amended by the Agricultural Improvement Act of 2018).

The Gabbard amendment was included in the final version of the bill which passed, 295-125, and now goes to the Senate for consideration.

“There is great research being done around hemp, resulting in new products coming to market that are proven to help with ailments like insomnia, inflammation, chronic pain, epilepsy, Traumatic Brain Injury, Post-Traumatic Stress and more. Hemp products provide a form of treatment that serves as an alternative option for those who would rather pursue natural remedies rather than prescription drugs.

This amendment passed with strong bipartisan support, ensuring our servicemembers have access to the same over-the-counter products that Americans all across the country benefit from today,” said Rep. Tulsi Gabbard.

The 2018 Farm Bill, known as the Agricultural Improvement Act, legalized hemp, defined as cannabis (Cannabis sativa L.) and derivatives of cannabis with extremely low concentrations of the psychoactive compound delta-9-tetrahydrocannabinol (THC) (no more than 0.3 percent THC on a dry weight basis). Currently, many over-the-counter products are sold that meet these parameters.

December 2018 – The Farm Bill Legalized Hemp

Background: Rep. Tulsi Gabbard has long called for sensible marijuana policies as part of her ongoing commitment to common sense criminal justice reform.

She introduced bipartisan legislation with Rep. Don Young (AK-at large) — the Ending Federal Marijuana Prohibition Act (H.R. 1588) and the Marijuana Data Collection Act (H.R. 1587). H.R. 1588 would remove marijuana from the federal controlled substances list. H.R. 1587 would direct the National Academy of Sciences to study the effects of state legalized medicinal and adult-use marijuana programs from a variety of perspectives, including state revenues, public health, substance abuse and opioids, criminal justice, and employment.

She has called for closing the gaps between federal and state law to resolve current contradictions and provide legally abiding marijuana businesses with clear access to financial services.

She joined several of her colleagues to introduce the bipartisan Secure and Fair Enforcement Banking Act (H.R.1595) in March 2019, which was passed by the House in September 2019. The bill would help prevent federal banking regulators from penalizing depository institutions for providing banking services to a legitimate marijuana-related business.

She joined Rep. Jerry Nadler (NY-10), Chair of the House Judiciary Committee, in introducing H.R.3884, the Marijuana Opportunity, Reinvestment, and Expungement (MORE) Act.

She is a cosponsor of H.R.1456, the Marijuana Justice Act, to reform unjust federal marijuana laws and empower minority communities that have been disproportionately impacted by the failed War on Drugs. And, to protect veterans engaged in the state-legalized cannabis industry, Rep. Gabbard sent a letter to VA Secretary Robert Wilkie in June 2019 to demand a correction of the VA’s denial of loan guarantee benefits to these veterans.
