The legalization of marijuana varies drastically between states, with some lawmakers approving its use entirely, others allowing its use only for medical conditions, and some still punishing possession of the drug by a prison sentence.

Thirty-eight states currently have it legalized for medical use, with 24 permitting recreational use, allowing many Americans to have access to marijuana, also known as weed, in one way or another if they are over the age of 21

While it is still illegal on a federal level, President Joe Biden has made it clear that his administration intends to pursue decriminalization during his time in office. Whether this is likely ahead of the looming election, however, appears questionable.

Since Colorado and Washington’s legalization of recreational marijuana in 2012, 22 other states, and Washington, D.C., have slowly amended their laws in favor of decriminalizing the substance.

Five more states could amend their laws soon: Wisconsin, Florida, Hawaii, South Dakota, and South Carolina.

Amid the arrival of “4/20” day—a celebration for cannabis smokers each year, on April 20—Newsweek looks at some of the states that could push ahead with legalizing use of marijuana in some way.

Florida

Florida Marijuana Laws: The State of Smokable Marijuana in Florida

Florida voters will be able to decide if recreational use of marijuana should be legal in the state at the ballot in November.

Users will need to be 21 years or older to legally consume it. Medical marijuana is currently permitted.

Gov. Ron DeSantis has been one of the proposal’s most vocal critics, saying he believes recreational use of the drug should not be legal in the state

The law change will require a 60 percent approval for the amendment to pass when voters head to the polls in November.

Hawaii

A bill to legalize the recreational use of marijuana for adults in Hawaii was approved by the House Consumer Protection and Commerce Committee in March, raising hopes that laws could be extended from granting medical use.

The bill was earlier passed by the Hawaii Senate, and Gov. Josh Green, a Democrat, has indicated he would sign the bill into law once the House passes the second version.

The law would specifically allow anyone aged 21 and older to possess up to 1 ounce of marijuana and up to 5 grams of cannabis concentrates. Hawaiians would also be able to possess their own produce—up to six plants and up to 2 pounds of harvested marijuana.

It would also expunge the criminal record of past convictions related to cannabis possession.

South Dakota

South Dakotan law changes are less advanced down the legislative path than other states on this list but campaigning to legalize recreational use—as well as the already legal medical use—remains vocal.

The state has tried several times in the past to achieve this, including a 2020 election ballot from voters approving the law change. But the South Dakota Supreme Court shut down the approval as unconstitutional a year later.

Voters then rejected another initiative in 2022. Now campaigners are working again to put the question to the electorate in November, requiring almost 18,000 signatures by May.

At the start of the year Wisconsin appeared the most likely of any state to decriminalize medical marijuana, but a Republican bill fell flat ahead of an official vote.

The state bill was being considered to legalize use of the substance, but this would have been limited to severely ill people and would only be dispensed from five locations around the state. It would have also ruled out the legalization of smokable marijuana.

Leaders of the Republican-controlled Senate and state Assembly have largely supported the legalization, while Democratic Gov. Tony Evers has also previously voiced support to permit medical marijuana.

Currently possession of the drug is illegal in Wisconsin. Depending on the quantity of the substance you are caught with, it is possible to go to prison or incur heavy fines.

Despite the bill failing, conversation of reform has still grown steadily—and, while the state may fall short of legalization this year, Wisconsin remains one of the most likely areas of the country to proceed with medical marijuana laws.

Announcing the bill was effectively dead earlier this year, however, Assembly Speaker Robin Vos did give legalization supporters hope when he announced a public hearing to build support for passage next session would ensue later this year.

South Carolina

The South Carolina Senate passed a bill in February to allow the use of marijuana and related products for medical needs. But the bill has now sat in the state’s House of Representatives for two months with little hope of being debated on the floor.

State lawmakers will need to get a move on, with just weeks left before the House adjourns. Anything that does not make it to the House will have to be proposed again next year.

This has been the case for several years, with an almost identical bill dying in the House in 2022. Many state senators have been working for almost a decade to change the law.

It would still be illegal to smoke the drug or use it recreationally under the new law. Patients could instead use vaporizers or patches to gain the medical benefits.

Any use of cannabis is currently illegal in the state and can carry a fine of up to $1,000 and even 30 days to six months in jail.

The recreational use of marijuana is legal in 24 states, and Washington, D.C., as of April 2024. While jurisdictions differ on the legal quantity allowed for legal possession, almost half of U.S. states have now approved its use.

These include Alaska; Arizona; California; Colorado; Connecticut; Delaware; Illinois; Maine; Maryland; Massachusetts; Michigan; Minnesota; Missouri; Montana; Nevada; New Jersey; New Mexico; New York; Ohio; Oregon; Rhode Island; Vermont; Virginia; and Washington.

Other states have pushed ahead with legislation approving the substance’s use for medical conditions. While the laws vary, these states include Alabama; Arkansas; Kentucky; Louisiana; Mississippi; New Hampshire; North Dakota; Oklahoma; Pennsylvania; South Dakota; Utah; and West Virginia.

Marijuana is effectively illegal in the remaining 11 states: Georgia; Idaho; Indiana; Iowa; Kansas; Nebraska; North Carolina; South Carolina; Tennessee; Texas; and Wyoming.

Will the Cannabis Industry Ever GET HIGHER OPPORTUNITY?

There is a perception that licensed legal cannabis businesses are essentially printing money.

Year after year, mainstream news articles tout the exponential growth of the industry, the record-breaking sales figures each 4/20 and the increasing number of states enacting or considering legalization.

However, these reports exclude how increasing competition, festering federal uncertainty, a prospering illicit market and crippling taxes and regulations chip away at profits.

In fact, due to 280E, a typical multi-state operator is paying an effective tax rate of more than 60% each year, while Amazon’s effective federal income tax rate was 6.1% in 2021.

2022 Will Be a Regulators Recognition Day to the Majority

Although the cannabis space is still growing and will only increase in size, the sad truth is a reckoning is coming.

The realities of the macroeconomic conditions impacting every other industry cannot be avoided and are an increasing drag on an already overburdened industry.

Rising inflation rates and concerns over political uncertainty are taking a toll.

And the cannabis industry has its own unique problems that keep real progress at bay:

A high taxation rate pushes many consumers away from the regulated market and to illicit dealers where products aren’t guaranteed to be tested and safe.

Falling wholesale prices and increased competition force discounting that flatten margins.

The lack of federal legislative action on banking issues continues to weigh the industry down. Forces are combining to create the industry’s first sustained downturn, which is already underway.

There have been layoffs at high-profile cannabis tech companies. Shares of some publicly-traded cannabis companies have plunged more than 70% since February 2021.

Sales are off from projected levels. And merger and acquisition activity will continue to force rightsizing.

Price wars drive down revenue; social equity efforts stall Development of industrial agricultural processes in cannabis has led to commodification of the crop, pushing wholesale prices down by 18% year-over-year.

In the meantime, increased competition is leading some less sophisticated cannabis retailers and brands to dramatically discount products, relinquishing millions in bottom-line revenue in the process.

While price compression was expected, it arrived sooner and has been more formidable than anticipated.

And there’s little chance price compression will reverse on a commodity crop.

As states expand their markets by adding licenses for more dispensaries and producers in an effort to maximize tax revenue, the problem is exacerbated.

More outlets equal more taxes but also increased competition which has ignited a race to the bottom in discounting.

Progressive state laws embolden the illicit market.

The cannabis industry and many recent states legalizing adult-use cannabis have made it clear that cannabis policy is also a social equity issue.

But the progress of awarding licenses to social equity applicants is stymied by the industry’s ongoing lack of financing options.

It is laudable to award 50% of adult-use cannabis licenses to social and economic equity applicants as New York requires.

However, if these businesses cannot access necessary capital to stand up an operation, they will never succeed.

Until the industry’s longstanding banking problems are resolved at the federal level, social equity efforts are bound to fail.

Federal Policy: Dead on Arrival

Like everyone else, I was hopeful 2020’s ‘Blue Wave’ was going to be beneficial for the cannabis industry. But we were all bamboozled by politicians who lied to get the job and have not followed through on their empty promises.

Even despite the watershed moment of Senate Majority leader Chuck Schumer placing the full backing of his office behind cannabis legalization, midterm-election-year politics doom any real federal legislative progress this year.

As congressional minutiae around state protections and safe banking for cannabis continues, we are watching the slow-motion decimation of a powerful job-creating industry, hamstrung due to ineffective leadership that is over-regulating and overtaxing on a state level and completely disregarding and obstructing on a federal level.

President Biden ran on his support of the cannabis industry, yet continues himself to manufacture roadblocks against legalization while the country experiences an eye-popping 25% increase in federal cannabis arrests under the Biden regime.

Senator Schumer has been completely ineffective introducing legislation that overreaches and is DOA by the time it hits the floor.

While cannabis receives 92% approval at some level from bipartisan constituents, these voters’ representatives continue to work to override the will of the people.

The time to receive clear and defined guidance on banking issues from the federal government is now.

Our federal representatives must level the playing field for the cannabis industry and allow the same participation in corporate banking and taxes granted to every other regulated industry, from pharmaceuticals to the alcohol industry.

All is not lost:

What’s going right Despite the industry’s current ongoing challenges, growing pains should be considered as the natural lifecycle of a nascent industry certain to experience continued long-term growth.

Although layoffs are personally painful, eliminating redundancies and reducing costs are beneficial to a company’s health and necessary for rightsizing an organization for the long haul.

Rightsizing an organization demonstrates responsibility and accountability from senior leadership in an industry that often sees more ego-driven, inexperienced decisions.

Bottom-line: duplication and wasteful spending are just as bad in a good economy as one under pressure.

Smart reductions re-set the table for stability and long-term growth. Then it’s go-time for material progress, otherwise perhaps we need to see some change at the top.

In the end, long-term growth is the ultimate goal, particularly for an industry that is still in its infancy.

And the prospects for long-term growth are overwhelmingly positive.

In January, U.S. employment in the cannabis industry stood at nearly 429,000 full-time jobs and growing.

Even as the country went through the second year of the pandemic, the sector saw a 33% increase in new careers, creating more than 107,000 jobs thus far in 2022.

That’s about 280 new jobs per day. Of course, there will be tough decisions to be made in the near term. But industry job growth is expected to continue, especially as new markets come online.

In essence, the cannabis industry is not immune to the current economic instability impacting every other facet of the economy. But combined with the industry’s other unique challenges, this turmoil provides an opportunity to course-correct for the next stage of growth and the eventual reform at the federal level.

As cannabis industry leadership steps up to make the tough decisions, we can only hope – and demand – those political leaders do the same.

1 – Change is coming in the world of banking.

A lack of access to banking is not new news for the cannabis industry, which faces significant roadblocks in operation. But there are two potential beacons of hope for cannabis companies — the Secure and Fair Enforcement (SAFE) Banking Act and changes to the IRS Code 280E.

The SAFE Banking Act sets out to protect access to banking by members of the cannabis industry. It was passed in the House in 2019 but died in Committee. Since then there has been ongoing debate but its passage has been hindered by Republicans in the Senate. It was passed again in the House earlier in 2021 and is back at Committee stage.

There are also ongoing discussions about changes to IRS Code 280E. This specific section of the Internal Revenue Code prohibits the deduction of several business expenses on federal taxes for businesses presently engaged in trading controlled substances, like cannabis.

While these two pieces of proposed legislation are still being debated,  there are signs that momentum is building for change, and we predict that big things are coming soon.

2 – 2022 cannabis trends show that federal legalization is closer than ever.

It’s no secret that the legalization and decriminalization of cannabis are trending favorably. Even before the Presidential election of 2020, members of Congress had introduced several bills aimed at loosening federal restrictions or decriminalizing cannabis.

MORE Act

The Marijuana Opportunity Reinvestment and Expungement (MORE) Act, which would have decriminalized cannabis and expunged criminal records for nonviolent cannabis offenses.

STATES Act

The Strengthening the Tenth Amendment Through Entrusting States (STATES) Act would have prohibited federal enforcement actions against cannabis conduct that is otherwise compliant with state law.

The Cannabis Administration and Opportunity Act

The Cannabis Administration and Opportunity Act only complicated the legalization landscape even more in 2021. This comprehensive bill would significantly change how cannabis is regulated by the federal government, enable interstate commerce in cannabis, and decriminalize cannabis.

As with the banking situation, there is no clear and direct path to any of these bills becoming law. Regardless, it’s clear that Congress continues to push forward in favor of the cannabis industry.

Surprisingly, it’s not just the Democrats in Congress making moves. U.S. Republican Nancy Mace from South Carolina just introduced a new bill to decriminalize cannabis, promoting each state’s individual preference for treating cannabis. Again, while this bill is still some distance away from becoming law, this new and refreshing energy from a Republican in a red state could help thrust the ongoing debate forward.

3 – Integrated technology in cannabis is ever-evolving.

The cannabis industry is no stranger to integrated technology. To help evolve and refine the cannabis experience, we’re expecting a growth in the number of cannabis products and consumption tools that harness data and new technology emerging in the upcoming year.

From vapes that developers can routinely update to QR codes on product packaging, cannabis tech will continue to get more intelligent and innovative, on a par with all other smart household devices.

Cannabis is quickly embracing the Internet of Things, which will prove to be a benefit to producers and consumers alike. With the data this technology provides, marketers will begin to gain insight into what effects people are experiencing and how they are enjoying their cannabis.

4 – Say hello to consumption lounges.

One of 2022’s cannabis trends we’re most excited to see is the rise in the number of  consumption lounges and, as a direct result, the growing profile of cannabis in the tourism sector.

Because of the legality concerns of using cannabis in many states across the country, consumers have mostly been forced to indulge in private. But, as the market continues maturing and decriminalization gathers steam, consumers will begin pushing for more elevated experiences.

The solution to providing an elevated cannabis experience will be the introduction of consumption lounges.

Nevada has passed legislation allowing adults to eat or smoke cannabis in consumption lounges and in doing so has become the eighth state to legalize pot lounges. In mid-2022, we can expect to see the first Vegas consumption lounges opening.

While consumption lounges are mostly rarities and tend to be slow to open, they will set the stage for breaking down some of the boundaries the industry faces today. Consumption lounges will be sure to help with boosting cannabis sales, de-stigmatizing the plant, and potentially supporting social equity.

2022 Will Be CBGL Year To Watch

During the third fiscal quarter the Company continued to expand its customer base and the number of products manufactured and distributed. Four new products were launched in the edibles space and five in the solventless. New orders grew significantly during the quarter for solventless cannabis concentrates, zero cannabis taste edibles, and concentrate based flower products. Over the coming weeks the Company expects these products to be delivered to both storefront retailers and delivery companies. During the current quarter, which ends on August 31, 2022, the Company also expects to launch its Northern Lights brand consisting of premium flower-based products, edibles and solventless concentrates.

“During this recently reported quarter, we experienced numerous successes relative to product rollouts, customer orders and deliveries. We believe the strong growth in our order pipeline from significantly sized retailers will allow us to continue to experience growth in product revenues,” commented Arman Tabatabaei, Chief Executive Officer of Cannabis Global, Inc.

For the third fiscal quarter, the Company produced revenues of approximately $792,000, a sequential increase of approximately 25% over the previous quarter. Total assets rose to $14.9 million as of May 31, 2022 from approximately $11.4 million as of May 31, 2021.

Cannabis Global Commences “Fresh Frozen” Supply Contract with Sugarmade Inc

Los Angeles, California May 3, 2022, Cannabis Global, Inc. (CBGL), Cannabis Global, Inc., a licensed Los Angeles-based manufacturer and distributor in the cannabis sector, today announced an important supply agreement to solidify the Company’s position in the solventless cannabis product sector.

Under the terms of an agreement, Sugarmade, Inc. (SGMD) will cultivate cannabis specifically for Cannabis Global. The initial contract calls for the supply of 25,000 pounds of “Fresh Frozen” cannabis, which will be cultivated specifically to Cannabis Global’s specifications.

Fresh Frozen cannabis is immediately flash frozen upon harvest – instead of the traditional treatment of drying and curing after harvest.

This form of cannabis is almost exclusively used to create ultra-premium cannabis concentrates, such as live rosin, hash and live resin.

“This Agreement serves several very important purposes,” commented CEO Arman Tabatabaei. “By contracting with Sugarmade we will be able to specify exactly the strains and cultivation parameters that will enable us to produce the finest hash and rosin products for our customers. By locking in a $28 per pound future price, compared to the current spot price well in excess of $100 per pound, we expect our margins to be meaningfully enhanced. Perhaps even more importantly, having a steady supply of premium Fresh Frozen cannabis will allow us to provide consistency in our products and to ensure an adequate supply of products will be available to our very fast-growing base of retail customers. As we have recently announced, our retail base and our revenues are ramping quickly. This Agreement helps us to meet the substantial demand we are experiencing.

“The companies have signed a pre-booked, fixed-price contract for an initial 25,000 pounds for $700,000, which will include cash payments from Cannabis Global to Sugarmade of $300,000, with notes accounting for the remaining $400,000. Planting is expected to begin in mid-May and continue into early June. Cannabis Global will also hold an option to purchase additional pounds if the cannabis cultivation effort yields excess materials.

Mr. Tabatabaei continued, “We plan to process a significant amount of this material at our Lynwood California location. In addition, we will enter the wholesale space to supply up to 10 separate strains of Fresh Frozen Cannabis to other solventless manufacturers in the Los Angeles area. With the market for solventless products growing rapidly, we believe this agreement will be an important component of our future success.

 

Cannabis Global plans to launch its premium rosin line under the Wolfgang Wax brand name by way of its recent acquisition of the Caliwanna, LLC brands. In addition, Cannabis Global will utilize the rosin concentrates produced from the biomass to enhance its rosin preroll and edible lines, and in the future for inclusion in cannabis beverages and tinctures, we are currently in development.

(OTC CBGL), a licensed Los Angeles-based manufacturer and distributor in the cannabis sector today announces the Company’s intentions to apply for additional patent protection for its unique inventions for the creation of nanoparticles and nanofibers made for cannabinoids.

Cannabis Global will be filing for protection of its nanoparticle and fiber inventions in the European Union, Canada, and Israel.

Cannabis Global’s patent applications portfolio is a result of the Company’s launching of Project Varin during early 2021. The project has produced several cannabinoid-related R&D and manufacturing technique breakthroughs. For example:

Slow-release cannabinoid nanofibers and nanoscale particles using edible gelatin created from food-grade acetic acid-water-based solutions. The Company believes this invention will allow product formulators to tailor products with selectable release parameters. The results also confirmed that agglomeration can be fostered and/or avoided and suggest that particles can remain suspended over long periods of time, which could facilitate innovative beverage formulations.

Quick dissolving THC and CBD hi nanofiber scaffolds were developed that almost instantly dissolved in water. This technology was specifically designed to be used in ultra-fast-acting cannabinoid delivery applications.

Tetrahydrocannabivarin (THC-V) nanofibers at 75-nanometers at 70% concentrations that were readily soluble in water. Considering the very high cost of obtaining this rare cannabinoid, the use of THC-V in a nano format could enable a host of unique product formulations. The average width of the fibers was from about 200 nm to 400 nm, which have around 6,000 times more surface area than would be available if present in spherical form.

Mr. Tabatabaei continued, “These new nano cannabinoid delivery technologies were designed to allow beverage, food, and cosmetic product formulators to design into products for fast or slow release parameters cannabinoids and/or to use significantly less cannabinoids in products while achieving similar or meaningfully greater efficacy.

Our patent filing covers not only the new processes developed to create the new forms of cannabinoids but also the nanoparticles and nanofibers using the outlined processes and ingredients. We are especially proud of the fact we have been able to use food-grade ingredients in many of the formulations allowing consumer product companies to produce the clean labels consumers are increasingly desiring.”
