This is my past, present, and future vision by Steven M. Smith, Founder & CEO of Inspirational Technologies – September 2025 – Over a decade ago, Inspirational Technologies set out to combine natural wellness with advanced science, and now we’re taking a bold leap forward. Founded in 2013 by Steven Smith, our journey began as a small Florida startup with a mission to connect traditional botanical remedies with modern technology. 2013–2015: Laying the Groundwork

In the early years (2013–2015), we laid critical groundwork. Steven Smith’s background in plant sciences and passion for holistic health drove the initial focus on researching plant-based compounds, particularly those in hemp and other medicinal herbs. We were essentially a research lab with a big dream: to validate traditional botanical remedies using rigorous modern science. During this time, we established an education hub on our website (InspirationalTech.org) to share research updates and demystify hemp for the public. This proved vital in combating public misconceptions, as many people at the time still conflated hemp with psychoactive cannabis. Indeed, throughout the 20th century, stigma and prohibition had severely complicated cannabis research, and in the early 2010s hemp was legally categorized alongside narcotics despite its lack of THC. Navigating this environment was challenging – regulations were murky, funding was limited, and we often had to explain that hemp isn’t about “getting high,” but about healing. Challenges: Regulatory uncertainty was the toughest hurdle in our infancy. Government rules around cannabis research were ambiguous or restrictive, making it difficult to source materials and secure funding. Public perception was another obstacle; early on, some investors and consumers were wary, not yet educated on the difference between non-intoxicating hemp compounds and marijuana. We tackled these challenges through education and transparency. By openly sharing scientific findings and safety data on our website and in community seminars, we started changing minds.
In 2014, our persistence paid off: we secured our first private investment, providing much-needed R&D capital, and validated our vision to those who believed in the potential of cannabinoids. That same year we launched our website as a content hub, positioning Inspirational Technologies as a trustworthy voice explaining the science of CBD and hemp. This focus on education built credibility and began eroding the stigma.
Successes: Despite the headwinds, by 2015 we had established a solid foundation. We had a small lab, a growing network of academic collaborators, and early data hinting at hemp’s therapeutic promise. For example, our team initiated studies on hemp-derived compounds and their effects on conditions like inflammation and anxiety, drawing on expertise from university partners. These academic collaborations not only guided our research but also validated our early findings in peer-reviewed settings, showing that our work was on the right track. We closed 2015 with optimism – and a budding reputation as pioneers willing to push botanical science into new territory.

2016–2018: Expanding into Hemp and Cannabinoids

By the mid-2010s, cannabidiol (CBD) was gaining mainstream attention as a potential wellness game-changer. Research interest in CBD was exploding worldwide, and public awareness of hemp’s benefits was on the rise. Inspirational Technologies embraced this momentum and shifted focus squarely onto hemp-derived cannabinoids. This period marked our evolution from a general plant research startup into a dedicated hemp innovation company.
Research Milestones: Between 2016 and 2018, we embarked on ambitious studies of CBD’s potential health benefits. Our research teams (now working with medical scientists) explored how CBD could help reduce anxiety, alleviate inflammation, and even act as a neuroprotective agent for the brain. Early results were promising: for instance, preliminary experiments suggested CBD had notable anti-inflammatory effects (supporting what many others were finding), and could modulate stress responses in animal models. We weren’t alone in these discoveries – around this time scientific literature was burgeoning with cannabinoid research. Academic partners working with us published validating findings, adding credibility. The scientific community was confirming what we believed: CBD and related cannabinoids held real therapeutic promise. Notably, evidence began emerging that CBD might provide relief in anxiety without the downsides of THC. Product Development: Research findings quickly fed into product ideas. By 2017, we had developed our first prototypes of CBD-infused wellness products, including a topical cream for pain relief and a tincture (oral drops) for stress and general wellness. Formulating these was an exciting step from lab bench to real-world application. We sourced high-quality hemp extracts and combined them with synergistic herbs, leveraging our roots in botanical science to create unique blends. Each prototype was tested for safety and efficacy in small trials. The feedback from early testers was encouraging – users reported less joint pain after applying the cream, and better sleep with the tincture. This R&D phase taught us about effective dosing, bioavailability (for example, how well the body absorbs CBD in different forms), and user preferences. It set the stage for the full product line we’d launch once the regulatory coast was clear.
Obstacles: If you rewind to 2017, selling a hemp-based product was not straightforward. Federal law still treated hemp extracts in a gray zone, which made distribution and marketing a tricky affair. We could develop products and even give out samples, but large-scale sales were hampered by legal ambiguity. Shipping CBD across state lines lived in a legal limbo – technically hemp was still a Schedule I substance federally, even though it has no high-inducing THC. This meant we had to proceed carefully and focus on states with clear hemp programs. We also had to be very cautious about marketing language, avoiding any medical claims that could draw ire from regulators (the FDA had started warning companies about unproven claims). Yet, we persisted, keeping our operations lean and compliant. We engaged with industry groups advocating for hemp law reform, and continuously educated lawmakers and the public on CBD’s safety. 2019–2022: Growth through innovation and Partnerships

With legal clarity achieved, Inspirational Technologies moved full speed from R&D into the marketplace. The period from 2019 to 2022 was one of rapid growth, new partnerships, and establishing our leadership in the hemp wellness space. We transitioned from a small startup into a recognized brand with a national reach.

Commercial Launch: In early 2019, we officially launched our first line of CBD-based wellness products to the public. The line included the refined versions of our topical CBD cream and sublingual tincture, now branded under the Inspirational Technologies banner, as well as capsules and an all-natural CBD balm. We leveraged e-commerce and select health store partnerships for distribution. The timing was perfect: consumer interest in CBD had exploded, and people were eager to try these newly legal remedies. In fact, by 2020 nearly one-third of U.S. adults had used a CBD product, a huge leap in adoption from just 14% in 2019. We were ready to meet the demand with products formulated on a foundation of science and quality. Each batch was lab-tested for purity and potency, and we published the results online to continue building trust through transparency.

Partnership with hempSMART:
A key milestone in this phase was our strategic partnership with hempSMART in 2019.
HempSMART – a California-based company known for its science-driven CBD formulations – shared a similar ethos with us. By partnering, we aimed to combine our strengths: Inspirational Technologies’ research and product innovation, with hempSMART’s established marketing channels and customer base. Together, we celebrated on product development and education. For example, we co-hosted webinars featuring experts like Paula Vetter (hempSMART’s medical advisor) to inform consumers about CBD’s benefits. This partnership expanded our reach across the U.S. and even into international markets where hempSMART had a presence. It was a win-win: hempSMART gained new formulations and R&D support, while we gained a ready distribution network and a boost in brand visibility. Collaboration has always been in our DNA, and this was a powerful example of how working with like-minded innovators could amplify our impact.
Scaling Up: Internally, these years saw our team grow and our capabilities scale. We onboarded new talent – from formulation chemists to regulatory consultants – to handle everything from product manufacturing to compliance in a fast-evolving regulatory environment. In 2020, hempSMART opened a larger production facility in Florida, enabling us to increase output to meet surging demand.
Our efforts at maintaining high standards earned recognition: by 2021, Inspirational Technologies was being recognized as a leader in hemp-based innovation, with industry magazines featuring our story and calling out our commitment to quality. We also invested in intellectual property, filing patents related to advanced cannabinoid extraction techniques and delivery methods (like a water-soluble CBD nanoemulsion to improve absorption).
This era wasn’t without its challenges, of course. The regulatory landscape, while improved, remained complex – the FDA still hadn’t fully figured out how to categorize CBD products, and we had to stay on top of patchwork state regulations. With widespread legality and a mountain of supporting research, cannabinoids are poised to transform mainstream healthcare and wellness. In this context, Inspirational Technologies is embracing a new frontier. Our new direction will leverage everything we’ve learned over the past 12 years and push further to realize the full potential of hemp-based science. Here’s what to expect as we move forward:
1. Pioneering Advanced Therapeutics: The heart of our new direction is a commitment to deeper scientific exploration of cannabinoids and their medical potential. CBD opened the door, and now we’re walking through it with a toolkit of cutting-edge science.     • Interestingly, cannabis was once legally imported across borders over a century ago, but its perception changed due to political climate shifts and propagandists associating it with negative sentiments1.
    • It’s been nearly eight months since the Drug Enforcement Administration (DEA) received an official recommendation to reclassify cannabis as a Schedule III drug, yet this possibility continues to be a top storyline throughout the industry in 2024.Specifically, Attorney General Merrick Garland has to offer three findings before the DEA issues its pending decision to potentially reschedule cannabis under the Controlled Substances Act, including its 1.) currently accepted medical use; 2.) relative abuse potential; and 3.) physical and psychological dependence liability.Garland and DEA officials also are likely weighing the U.S.’s international treaty obligations under the Single Convention on Narcotic Drugs, 1961, which rescheduling opponents continue to hammer on as a reason to keep cannabis listed as a Schedule I drug. Prohibitionists also continue to point to the dangers and health risks of cannabis as another reason.But cannabis wasn’t always treated this way. In fact, the plant was once a legal cross-border import more than 100 years ago, when “the federal government was not overly concerned with marijuana,” according to the U.S. Customs and Border Protection.The political climate toward cannabis began to change in the early 20th century, when immigration across the southern border spiked due to the Mexican Revolution in 1910, paving way for propagandists to play on fear and prejudice by associating refugees fleeing to the U.S. with a negative sentiment around cannabis, according to TIME.

      Prohibition in the U.S.

      Federal cannabis prohibition dates back roughly 90 years in the U.S., with the 1937 passage of the Marihuana Tax Act, which outlawed the nonmedical use of cannabis, and regulated cannabis importation, cultivation and distribution. This legislation came following the 1936 production of propaganda film “Reefer Madness,” which infamously claimed, “marijuana is … the real public enemy number one.”

      Many states began prohibition of recreational cannabis in the preceding decades, starting in 1913 with states like Wyoming and California, which have vastly different approaches to cannabis in today’s age of reform. By 1933, there were 29 states that banned cannabis, according to authors of the 2014 book “Prohibition, Religious Freedom, and Human Rights: Regulating Traditional Drug Use.”

      Two decades later, the Boggs Act of 1952 and Narcotics Control Act of 1956 stepped up America’s cannabis war by enacting stricter drug sentencing laws. These laws set mandatory sentences for cannabis-related offenses, including two to 10 years imprisonment with a fine of up to $20,000 for first-time offenders of cannabis possession.

      But it wasn’t until President Richard Nixon signed the 1970 Controlled Substances Act (CSA) that cannabis became classified as a Schedule I federally controlled drug, right up there next to heroin, LSD and ecstasy—the only classification on the CSA where drugs have no accepted medical use. Meanwhile, cocaine and fentanyl are considered Schedule II drugs.

      Despite the Schedule I designation, 11 states decriminalized cannabis in the 1970s, starting with Oregon in 1973, according to The Oregonian. This wave came following the bipartisan Shafer Commission determining that cannabis should be decriminalized for personal consumption. (Although Nixon appointed nine of the commission’s members, he rejected its recommendation.)

      Still, the drug war continued. President Ronald Reagan signed the Anti-Drug Abuse Act of 1986, which then-Sen. Joe Biden co-crafted to authorize new funding for drug treatment programs and stricter penalties for drug offenses. And in 1989, President George H.W. Bush declared a new drug war in a national televised speech: “All of us agree that the greatest domestic threat facing our nation today is drugs,” he said.

      The Green Wave

      In 1996, California ignited the present-day cannabis legalization wave when voters approved Proposition 215 with a 55.6% majority to exempt patients and caregivers from prohibition laws. Image result for Proposition 215

    • As of 2024, 38 states have legalized medical cannabis in manners that don’t severely limit access to patients, while 24 states and Washington, D.C., have legalized adult-use cannabis. As this landscape continues to evolve, a record-high 70% of Americans think marijuana should be legal, according to Gallup pollsters. It wasn’t until 2013 that the majority of Americans agreed in support of this issue.

      This landscape has provided booming (and bust) business opportunities in many state-legal markets: The 20 states that had operational adult-use retail markets in 2023 sold roughly $23 billion in cannabis, according to government data collected by Cannabis Business Times.

      And the industry continues to grow with each new market that comes online: Connecticut, Missouri and Maryland all launched adult-use sales in 2023, while Ohio is scheduled to commence sales in 2024, and Delaware and Minnesota are working toward starting sales in 2025.

      In addition, Florida has the potential to launch adult-use sales in 2025 should Smart & Safe Florida’s “Yes on 3” campaign attract 60% supermajority support for its constitutional amendment in this November’s election.

      Federal Cannabis Reform in 2024

      Among countless variables that could impact the cannabis industry in 2024, many stakeholders are keen on three main reform prospects at the federal level: the DEA’s pending rescheduling decision, the SAFER Banking Act’s passage, and the Farm Bill’s reauthorization.

      Although cannabis advocates with the “deschedule or do nothing” approach have said rescheduling cannabis would only continue the disparities of cannabis criminalization, incremental reform via a Schedule II or III listing could have myriad ripple effects related to industry oversight and enforcement, scientific research, criminal justice reform, and normalization should the DEA finally decide that cannabis does indeed have currently accepted medical use in the U.S.

      On the business front, reclassifying cannabis under the CSA would ease certain tax burdens on state-licensed cannabis operators, including lifting Section 280E of the internal revenue code that currently restricts cannabis companies from deducting many expenses related to running their operations.

      While DEA officials have not publicly addressed a timeline for their rescheduling review process, this process was directed by President Joe Biden, who has played up his cannabis reform policies during his 2024 reelection campaign. That said, many have speculated that an announcement from the DEA will come this year.

      SAFER Banking Act

      Current legislation to provide safe harbor to financial institutions wishing to service the cannabis industry—the Secure and Fair Enforcement Regulation (SAFER) Banking Act—has advanced as far as it ever has in the U.S. Senate, which is leading the charge this Congress.

      After a major victory with the Senate Banking Committee advancing the legislation during a markup hearing in September, the SAFER Banking Act continues to await Senate Majority Leader Chuck Schumer, D-N.Y., to call the bill to the floor for a vote.

      But now with key federal government funding packages in the rearview mirror, Schumer included the SAFER Banking Act among a short list of legislative priorities this year, saying last month he’ll turn to it soon.

      Schumer also said he was committed to including criminal justice provisions, like the Harnessing Opportunity by Pursuing Expungement (HOPE) Act, in the SAFER Banking Act, as well as the Gun Rights and Marijuana (GRAM) Act, which would allow state-legal cannabis consumers to purchase and possess firearms—the latter of which could help attract broader bipartisan support for the bill, which currently has 32 Democrats and four Republicans signed on for sponsorship.

      Specifically, U.S. Sen. Jacky Rosen, D-Nev., reintroduced the HOPE Act on April 18. The bill would provide a federal grant program to help expunge cannabis convictions and/or seal records in states where the plant has been legalized or decriminalized.

      “Having a record for something that is now legal in our state threatens Nevadans’ ability to get a job, apply for housing, and contribute to our state’s economy,” Rosen said Thursday in a press release.

      The HOPE Act’s introduction is a positive sign for the SAFER Banking Act’s path forward, Schumer said on social media April 18, but the majority leader must also extend his reach to the U.S. House, which is now under Republican control.

      Previous versions of safe banking legislation passed the House seven times under Democratic control between 2019 and 2022 but were stonewalled by Senate leaders each time.

      2024 Farm Bill Reauthorization

      Should intoxicating cannabinoid products derived from hemp be regulated like cannabis?

      This is a critical question posed by industry stakeholders to congressional leaders charged with reauthorizing the Agriculture Improvement Act (Farm Bill) later this year.

      While the 2018 Farm Bill federally legalized industrial hemp—defined by having no more than 0.3% THC on a dry-weight basis—beyond state pilot programs, many hemp-derived products containing intoxicating amounts of delta-8 and delta-9 THC have proliferated the marketplace, landing on shelves at smoke shops, gas stations and convenience stores throughout the nation.

      This has been great for businesses in states with prohibitive cannabis laws such as Texas, where companies in the state’s hemp and severely limited medical cannabis industries generated more than $8 billion in revenue and employed more than 50,000 workers in 2022, according to a Whitney Economics estimate.

      Nationwide, U.S. hemp-derived cannabinoid sales were “conservatively” estimated to be $28.4 billion last year, according to a Whitney Economics’ 2023 national cannabinoid report. Roughly 10% of that sales total was attributed to nonintoxicating CBD products.

      Beau Whitney, who founded the cannabis and hemp data and analytics firm in 2014, previously told Cannabis Business Times that $7.1 billion of the $28.4 billion is considered “gray or illicit sales.”

      But many licensed cannabis operators in adult-use states, where these hemp-derived products often end up via interstate commerce, have taken the position that the Farm Bill was intended to separate hemp and cannabis in a nonintoxicating-versus-intoxicating manner. Otherwise, cannabis operators who often pay a premium for their state licenses—not to mention additional taxes and regulatory compliance—claim they are at a disadvantage.

      In an April 10 letter to key U.S. lawmakers, the U.S. Cannabis Council (USCC), which represents many of the biggest players in the regulated cannabis industry, proposed that the new Farm Bill includes language to exclude intoxicating hemp products from the definition of hemp and instead consider them cannabis.

      “This proposal protects the allowances granted to farmers, allowing legitimate agricultural and industrial hemp producers the flexibility they need to navigate the changing plant characteristics when growing in the field, while taking away the loopholes that have created the current gray market environment for unregulated hemp-derived intoxicants,” USCC Executive Director Edward Conklin wrote in the letter.

      Federal Legalization Bills

      There are three broad cannabis legalization bills primarily at play this Congress, including one backed by 87 House Democrats, another backed by five bipartisan House members, and another Democratic-back bill that’s teed up for reintroduction in the Senate.

      In September 2023, Rep. Jerry Nadler, D-N.Y., reintroduced the Marijuana Opportunity, Reinvestment and Expungement (MORE) Act, legislation that intends to legalize cannabis at the federal level through decontrolling and decriminalizing the plant, as well as provide expungements for certain cannabis offenses and create reinvestment opportunities for those adversely impacted by prohibition.

      Nadler is joined by 86 of his Democratic colleagues in backing the bill, which is indicative of the legislation’s partisan history. Previous versions of the MORE Act have passed the U.S. House twice before, most recently in a 220-204 vote that fell almost entirely along party lines in April 2022. With the House now under Republican control, the current rendition hasn’t made any headway.

      On the right side of the aisle, in October 2023, Rep. Nancy Mace, R-S.C., reintroduced the States Reform Act of 2023, legislation that would legalize cannabis by amending the Controlled Substance Act and provide for federal regulation in a manner similar to alcohol.

      Mace’s bill has the bipartisan support of four co-sponsors, including Reps. Tom McClintock, R-Calif.; Dean Phillips, D-Minn.; David Trone, D-Md.; and Matt Gaetz, R-Fla. But this legislation, too, has yet to receive a committee hearing.

      And then there is the Cannabis Administration and Opportunity Act (CAOA), which Schumer and fellow Democratic Sens. Ron Wyden, D-Ore., and Cory Booker, D-N.J., first filed last Congress. Schumer said during the 2024 National Cannabis Policy Summit on April 17 that the trio plans to reintroduce the CAOA this Congress.

      The previous version of this legislation proposed a 25% federal cannabis tax on any products produced in or imported into the U.S. And while it would have granted states the power to keep or administer their own oversight programs, it also would have transferred federal jurisdiction over cannabis from the DEA to the Food and Drug Administration. Some stakeholders and industry advocates hoped these two key provisions were amended at the time (but the legislation did not gain traction last Congress).

      “I have more exciting news to share,” Schumer said Wednesday during the summit. “This month, along with Senators Booker and Wyden—my colleagues—we will be introducing the Cannabis Administration and Opportunity Act, which fully de-schedules cannabis at the federal level. Cannabis legalization has proven successful at the state level. It’s high time that Congress catches up with the rest of the country.”

      Of course, cannabis reform is not easy, especially in a divided government, he said.

  2. Florida’s Cannabis Market:
    • Florida’s cannabis market is poised for significant growth. A recent court decision allows a cannabis legalization proposal to appear on the November 2024 election ballot. If approved, this could lead to a 400% growth in the state’s already substantial $6 billion cannabis market2.
    • The state’s retail cannabis landscape has been expanding, with 628 dispensaries by April 2024. Additionally, the medical cannabis sector boasts over 878,000 patients, and sales reached $2.6 billion in 2023, marking an 18% increase from the previous year3.
  3. Voter Support for Adult-Use Cannabis:
    • Florida’s Supreme Court recently approved the ballot language for a citizen-initiated constitutional amendment to legalize adult-use cannabis. This measure will be put to a vote in the November 2024 election4.
    • Florida cannabis businesses, advocates and enthusiasts celebrated a win on April 1, when the state’s Supreme Court decided the ballot language for a citizen-initiated constitutional amendment to legalize adult-use cannabis was sufficient to appear on the November 2024 election ballot, after state Attorney General Ashley Moody had filed an argument against allowing the measure to go before voters. But with a 60% supermajority vote needed at the voting booths in November to approve Amendment 3, a new Ipsos poll suggests voter support may not be sufficient. Fifty-six percent of registered voters in Florida say they would vote in favor of the ballot measure that would allow adults to purchase and possess personal amounts of cannabis, according to the Ipsos poll. Forty percent say they would oppose it, and 4% are unsure.The latest poll conflicts with a November 2023 survey conducted by pollsters at the University of North Florida’s Public Opinion Research Lab, which found that 67% of voters said they would support the constitutional amendment and just 28% of those surveyed said they’d vote against it.“Among 13 states that have legalized adult-use cannabis through citizen-initiated ballot measures, only Arizona, in the 2020 election, has met that 60% threshold. New Jersey (67.1%) and Maryland (67.2%) voters approved legislative-referred referendums,” Cannabis Business Times reported.
    • Smart & Safe Florida (@SmartandSafeFl) / TwitterStill, the initiative, sponsored by Smart & Safe Florida, has raked in substantial financial backing. Tallahassee-based multistate cannabis operator (MSO) Trulieve had contributed more than $40 million prior to the Supreme Court’s April 1 ruling, CBT reported. Following the ruling, Trulieve was joined by six other MSOs in contributing an additional $15 million in funding for the campaign, Smart & Safe Florida announced April 3, hoping to help the campaign get the 60% supermajority vote needed at the polls.
    • “Should voters cross the 60% threshold in November, adults 21 and older would be able to purchase and possess up to 3 ounces of dried flower or 5 grams of concentrate for personal use with the effective date of the amendment coming six months after the election,” CBT reported. The Florida Legislature would determine a process for licensing additional market entrants.Florida’s cannabis market, currently only legal for medical use, is already one of the largest in the U.S., generating more than $2 billion in sales 2023, according to estimates by data and analytics firm Brightfield Group.
    • The cannabis industry sees this referendum as a potential game-changer, allowing voters to decide whether to embrace recreational marijuana in a state that has a well-established medical cannabis program5.
    • When the Florida Supreme Court earlier this month approved a November referendum on legalizing marijuana in the Sunshine State, it set off celebrations around the national cannabis industry.

      While 24 states have legalized recreational marijuana so far and at least 38 have legalized its medical use, Florida presents the industry with a jewel of an opportunity. The Sunshine State has one of the fastest-growing populations in the U.S., a well-established medical marijuana business with more than 800,000 patients, and is one of the world’s top tourist destinations. Some 135 million people visited Florida last year from both domestic and international destinations.

      “The legalization of adult-use marijuana in Florida is not just a game-changer for the state’s economy but also a defining moment for the entire U.S. cannabis industry,” Headset, a marijuana-focused data company, said in a blog post after the court’s decision.

      Already at around $2 billion in medical marijuana sales, “Florida could see $4.9 billion to $6.1 billion in sales” during the first year of recreational marijuana, Headset estimates.

       

       

      “Florida is unique,” says Kim Rivers, CEO of Trulieve, the leader in the state with more than 130 medical marijuana dispensaries. Trulieve was a main funder of the effort to get the referendum on the ballot, contributing $40 million, but now a broader range of cannabis companies are joining the effort, raising $15 million for the Smart & Safe Florida campaign.

      Florida is a state with significant sporting and cultural events that draw people to it, Rivers notes, and it borders two neighboring states with restricted access to cannabis: Georgia offers limited medical marijuana and Alabama still doesn’t dispense medical marijuana to its residents despite approval back in 2021.

      The Florida referendum that will be on the November ballot will allow marijuana use by those over 21, but the exact terms of how much, whether it will be taxed, and other rules will be determined by the state legislature. Lawmakers will have six months from the referendum’s passage to develop a structure for the recreational use, although existing medical dispensaries in the state are grandfathered in.

      Other states that have both medical and recreational marijuana have chosen to tax the latter and that may well be the case in Florida. Also, pricing can be different for medical and recreational products in states that have both. Those who qualify for medical marijuana in Florida do pay an annual fee of $75 in addition to any charges that a doctor might levy to review the patient and any checkups.

      The Florida medical marijuana market is extremely competitive, with aggressive discounting. Smokable flower accounts for 47.1% of the sales, according to Headset, with concentrates that include edibles, vape pens, topicals and tinctures, accounting for the other 52.9%. But insiders say the expansion into the recreational market could bring new products and pricing to the market.

      In a blog post, Headset pointed to Maryland as a state that legalized recreational marijuana in 2023 after having a successful medical program. “We observed a 2.25x increase in monthly sales immediately following legalization, with a 2.4x increase at market maturity,” the company wrote.

      Passage is expected by advocates, but the threshold is high. Sixty percent of voters will have to approve the measure. The presence of a different referendum enshrining abortion rights could increase overall voter turnout, but it is unclear how that would affect the marijuana vote.

      poll late last year by the University of North Florida found 67% approving of the idea of recreational marijuana. Support was widespread with 78% of Democrats supporting it and 55% of Republicans. Majority support was found in every age group, with the highest among 18-24-year-olds at 86% and the lowest at 51% for those 65 and older.

      Indeed, Florida’s cannabis landscape is distinctive. Kim Rivers, the CEO of Trulieve, which boasts over 130 medical marijuana dispensaries, aptly characterizes the state’s uniqueness. Trulieve played a pivotal role by contributing a substantial $40 million to support the referendum’s inclusion on the ballot. However, the momentum has expanded, with a diverse array of cannabis companies rallying behind the cause. These companies have collectively raised $15 million for the Smart & Safe Florida campaign1.

      “I would absolutely expect all the businesses to increase market share,” says Michael Binder, faculty director of the Public Opinion Research Lab at UNF. “If you make it easier, people will do it more.”

      Industry insiders say the recreational market may be made up more of casual users, those who may not have access to a regular doctor, and tourists and others who may be occasional users.

      “There’s really no stereotype of a medical user,” says Jason Erkes, chief communications officer at Cresco Labs, operator of 33 Sunnyside retail dispensaries in Florida. “There’s substantial room for growth in Florida. The issue is to regulate it and convert the illicit users to the legal market.”

      Although Republican Gov. Ron DeSantis opposed the referendum, he is not expected to stand in the way of it being legalized and so far, the only stated opposition has come from the Florida Chamber of Commerce.

MJBizCon kicks off in Las Vegas amid economic turmoil, hopes of marijuana reform

MJBizCon, the oldest and largest trade show in the cannabis industry, officially opens Wednesday amid growing economic challenges and renewed hope that federal marijuana reform will help the industry in the wake of this month’s midterm elections.

Now in its 11th year, MJBizCon runs through Friday and features more than 1,400 exhibitors, 70-plus hours of educational content and 180 speakers.

More than 380 exhibiting companies are new to the showcase this year.

The expo hall, the largest in MJBizCon history, spans nearly 280,000 square feet on two floors of the Las Vegas Convention Center’s South Hall.

It’s where tens of thousands of cannabis industry professionals will convene for networking, startup funding, strategic partnerships, insights on regulatory reform and the political landscape and other topics.

High Roller

This year’s event arrives amid another critical juncture for the industry.

Cannabis companies, like others in mainstream sectors, are laying off workers and implementing other cost-cutting measures as prices for wholesale marijuana fall and recessionary concerns rise.

Meanwhile, the Biden administration has set in motion a process that could lead to revolutionary changes for federal marijuana policy.

The midterm elections, which often highlight the nation’s political polarities, provided a mixed bag of results on the marijuana front.

Among the many changes this year at MJBizCon, a new design divides the exhibition floor space into four distinct pavilions to help attendees find what they need:

  • Cultivation products and services.
  • Processing, packaging and lab services.
  • Retail and dispensary.
  • Business services.

“We can’t wait for everyone to see what’s new at MJBizCon – new exhibitors, a reorganized show floor, an outdoor patio,” said Jess Tyler, MJBiz’s senior vice president for events and sales.

“We really upped the experience this year.”

The DEA has shared its final production quotas for research drugs for 2023 and is now aiming for further manufacturing goals of several psychedelic compounds than the already substantial increases regarding 2022 initially proposed, reported Marijuana Moment.

The compounds include marijuana, MDMA, psilocyn, LSD, mescaline, 5-MeO-DMT, MDA, and 2-CB.

The agency stated that it is “committed to ensuring an adequate and uninterrupted supply of controlled substances in order to meet the estimated legitimate medical, scientific, research, and industrial needs of the U.S., for lawful export requirements, and for the establishment and maintenance of reserve stocks.”

As such, 2023’s production quota numbers for psilocyn would go from the original 8,000 grams to 12,000 grams, 5-MeO-DMT from 6,000 to 11,000, MDMA from 8,200 to 12,000 grams, MDA from 200 to 12,000 grams, and 2-CB from 25 to 5,100 grams.

In the case of marijuana, the DEA suggested the production of 6.7 million grams -or 14,770 pounds- for medical and scientific purposes, more than double that of 2022. Licensed cultivators can now apply to become federal marijuana suppliers under the National Institute on Drug Abuse (NIDA.)

Several companies have already made recommendations to raise DEA’s 2023 proposed quotas in view of pre-clinical and clinical research particularly for PTSD, TRD, schizophrenia and anxiety.

The proposal also received a comment regarding the creation of “diversified categories” for production and research on psilocybin-containing fungi fruiting bodies/sclerotia/liquid culture similar to cannabis (flower), fruiting body extract (akin to cannabis extract), and psilocybin and psilocyn separately as purified compounds (akin to delta-9-THC), as well as applying that same system for mescaline and other plants, fungi and lifeforms producing these compounds.

But the agency replied stating that the suggestions “do not impact the analysis involved in establishing” the production quotas for each substance.

Nonetheless, the DEA seems to be listening to what is taking place in the psychedelics space, as it has recently backed down on banning two psychedelic compounds claimed to have scientific value as well as a separate project to list five tryptamines as Schedule I substances.

Will the Cannabis Industry Ever GET HIGHER OPPORTUNITY?

There is a perception that licensed legal cannabis businesses are essentially printing money.

Year after year, mainstream news articles tout the exponential growth of the industry, the record-breaking sales figures each 4/20 and the increasing number of states enacting or considering legalization.

However, these reports exclude how increasing competition, festering federal uncertainty, a prospering illicit market and crippling taxes and regulations chip away at profits.

In fact, due to 280E, a typical multi-state operator is paying an effective tax rate of more than 60% each year, while Amazon’s effective federal income tax rate was 6.1% in 2021.

2022 Will Be a Regulators Recognition Day to the Majority

Although the cannabis space is still growing and will only increase in size, the sad truth is a reckoning is coming.

The realities of the macroeconomic conditions impacting every other industry cannot be avoided and are an increasing drag on an already overburdened industry.

Rising inflation rates and concerns over political uncertainty are taking a toll.

And the cannabis industry has its own unique problems that keep real progress at bay:

A high taxation rate pushes many consumers away from the regulated market and to illicit dealers where products aren’t guaranteed to be tested and safe.

Falling wholesale prices and increased competition force discounting that flatten margins.

The lack of federal legislative action on banking issues continues to weigh the industry down. Forces are combining to create the industry’s first sustained downturn, which is already underway.

There have been layoffs at high-profile cannabis tech companies. Shares of some publicly-traded cannabis companies have plunged more than 70% since February 2021.

Sales are off from projected levels. And merger and acquisition activity will continue to force rightsizing.

Price wars drive down revenue; social equity efforts stall Development of industrial agricultural processes in cannabis has led to commodification of the crop, pushing wholesale prices down by 18% year-over-year.

In the meantime, increased competition is leading some less sophisticated cannabis retailers and brands to dramatically discount products, relinquishing millions in bottom-line revenue in the process.

While price compression was expected, it arrived sooner and has been more formidable than anticipated.

And there’s little chance price compression will reverse on a commodity crop.

As states expand their markets by adding licenses for more dispensaries and producers in an effort to maximize tax revenue, the problem is exacerbated.

Department of Agriculture (USDA)

More outlets equal more taxes but also increased competition which has ignited a race to the bottom in discounting.

Progressive state laws embolden the illicit market.

The cannabis industry and many recent states legalizing adult-use cannabis have made it clear that cannabis policy is also a social equity issue.

But the progress of awarding licenses to social equity applicants is stymied by the industry’s ongoing lack of financing options.

It is laudable to award 50% of adult-use cannabis licenses to social and economic equity applicants as New York requires.

However, if these businesses cannot access necessary capital to stand up an operation, they will never succeed.

Until the industry’s longstanding banking problems are resolved at the federal level, social equity efforts are bound to fail.

Federal Policy: Dead on Arrival

Like everyone else, I was hopeful 2020’s ‘Blue Wave’ was going to be beneficial for the cannabis industry. But we were all bamboozled by politicians who lied to get the job and have not followed through on their empty promises.

Even despite the watershed moment of Senate Majority leader Chuck Schumer placing the full backing of his office behind cannabis legalization, midterm-election-year politics doom any real federal legislative progress this year.

As congressional minutiae around state protections and safe banking for cannabis continues, we are watching the slow-motion decimation of a powerful job-creating industry, hamstrung due to ineffective leadership that is over-regulating and overtaxing on a state level and completely disregarding and obstructing on a federal level.

President Biden ran on his support of the cannabis industry, yet continues himself to manufacture roadblocks against legalization while the country experiences an eye-popping 25% increase in federal cannabis arrests under the Biden regime.

Senator Schumer has been completely ineffective introducing legislation that overreaches and is DOA by the time it hits the floor.

While cannabis receives 92% approval at some level from bipartisan constituents, these voters’ representatives continue to work to override the will of the people.

The time to receive clear and defined guidance on banking issues from the federal government is now.

Our federal representatives must level the playing field for the cannabis industry and allow the same participation in corporate banking and taxes granted to every other regulated industry, from pharmaceuticals to the alcohol industry.

All is not lost:

What’s going right Despite the industry’s current ongoing challenges, growing pains should be considered as the natural lifecycle of a nascent industry certain to experience continued long-term growth.

Although layoffs are personally painful, eliminating redundancies and reducing costs are beneficial to a company’s health and necessary for rightsizing an organization for the long haul.

Rightsizing an organization demonstrates responsibility and accountability from senior leadership in an industry that often sees more ego-driven, inexperienced decisions.

Bottom-line: duplication and wasteful spending are just as bad in a good economy as one under pressure.

Smart reductions re-set the table for stability and long-term growth. Then it’s go-time for material progress, otherwise perhaps we need to see some change at the top.

In the end, long-term growth is the ultimate goal, particularly for an industry that is still in its infancy.

And the prospects for long-term growth are overwhelmingly positive.

In January, U.S. employment in the cannabis industry stood at nearly 429,000 full-time jobs and growing.

Even as the country went through the second year of the pandemic, the sector saw a 33% increase in new careers, creating more than 107,000 jobs thus far in 2022.

That’s about 280 new jobs per day. Of course, there will be tough decisions to be made in the near term. But industry job growth is expected to continue, especially as new markets come online.

In essence, the cannabis industry is not immune to the current economic instability impacting every other facet of the economy. But combined with the industry’s other unique challenges, this turmoil provides an opportunity to course-correct for the next stage of growth and the eventual reform at the federal level.

As cannabis industry leadership steps up to make the tough decisions, we can only hope – and demand – those political leaders do the same.

1 – Change is coming in the world of banking.

A lack of access to banking is not new news for the cannabis industry, which faces significant roadblocks in operation. But there are two potential beacons of hope for cannabis companies — the Secure and Fair Enforcement (SAFE) Banking Act and changes to the IRS Code 280E.

The SAFE Banking Act sets out to protect access to banking by members of the cannabis industry. It was passed in the House in 2019 but died in Committee. Since then there has been ongoing debate but its passage has been hindered by Republicans in the Senate. It was passed again in the House earlier in 2021 and is back at Committee stage.

There are also ongoing discussions about changes to IRS Code 280E. This specific section of the Internal Revenue Code prohibits the deduction of several business expenses on federal taxes for businesses presently engaged in trading controlled substances, like cannabis.

While these two pieces of proposed legislation are still being debated,  there are signs that momentum is building for change, and we predict that big things are coming soon.

2 – 2022 cannabis trends show that federal legalization is closer than ever.

It’s no secret that the legalization and decriminalization of cannabis are trending favorably. Even before the Presidential election of 2020, members of Congress had introduced several bills aimed at loosening federal restrictions or decriminalizing cannabis.

MORE Act

The Marijuana Opportunity Reinvestment and Expungement (MORE) Act, which would have decriminalized cannabis and expunged criminal records for nonviolent cannabis offenses.

STATES Act

The Strengthening the Tenth Amendment Through Entrusting States (STATES) Act would have prohibited federal enforcement actions against cannabis conduct that is otherwise compliant with state law.

The Cannabis Administration and Opportunity Act

The Cannabis Administration and Opportunity Act only complicated the legalization landscape even more in 2021. This comprehensive bill would significantly change how cannabis is regulated by the federal government, enable interstate commerce in cannabis, and decriminalize cannabis.

As with the banking situation, there is no clear and direct path to any of these bills becoming law. Regardless, it’s clear that Congress continues to push forward in favor of the cannabis industry.

Surprisingly, it’s not just the Democrats in Congress making moves. U.S. Republican Nancy Mace from South Carolina just introduced a new bill to decriminalize cannabis, promoting each state’s individual preference for treating cannabis. Again, while this bill is still some distance away from becoming law, this new and refreshing energy from a Republican in a red state could help thrust the ongoing debate forward.

3 – Integrated technology in cannabis is ever-evolving.

The cannabis industry is no stranger to integrated technology. To help evolve and refine the cannabis experience, we’re expecting a growth in the number of cannabis products and consumption tools that harness data and new technology emerging in the upcoming year.

From vapes that developers can routinely update to QR codes on product packaging, cannabis tech will continue to get more intelligent and innovative, on a par with all other smart household devices.

Cannabis is quickly embracing the Internet of Things, which will prove to be a benefit to producers and consumers alike. With the data this technology provides, marketers will begin to gain insight into what effects people are experiencing and how they are enjoying their cannabis.
